THEY’RE DONE & DUSTED: New Vision Remains Silent As Kampala Lawyer They Branded Fake Gets Second Count Victory

New Vision star reporter Charles Etukuri has made many innocent public officials lose their reputation yet his employer, New Vision, which is funded by the taxpayer, remains silent even after such senior citizens of Uganda, they previously condemned as crooks, get exonerated through clear processes of court. Kampala lawyer David Balondemu is one such example.

He was late last year arrested and persecuted by the state through malicious prosecution which the New Vision, which the taxpayer recently injected 25bn in, relied upon to declare him a fraudster.

The claim was that Balondemu, who the president had started to like very much after he advised him on how to save public land in Owino market, had used his law firm to defraud foreign investors even when none of the so-called victims had complained about him personally anywhere.

It was all pure witch-hunt targeting a well-intentioned public official which some extortionist New Vision editors have lately become synonymous with.

Last week Buganda Road Court G1 magistrate Winnie Nankya acquitted Balondemu after the DPP, fed on lies by investigators, failed to produce any evidence against him and implicating him in any extortionist schemes. This caused Balondemu’s lawyer Hassan Kamba to declare his client and accused person a victim of persecution by the state which they intend to sue and get money from for malicious prosecution.

Then on Monday, the magistrates court sitting at city hall of KCCA once again acquitted Balondemu on other similarly fabricated charges after the DPP failed to line up witnesses and produce any evidence against him.

The magistrate declared this a mistrial and condemned the DPP for accepting to be used by the mafias wanting to persecute Balondemu without being prepared to bring any evidence against him because they didn’t have any in the first place.

Balondemu’s lawyer Hassan Kamba praised the two magistrates of Buganda road and the one of city hall for standing firm against the state some of whose rogue-minded officials want to use the DPP to persecute his client well knowing he was innocent.

Outside the court room, Kamba told news reporters that they conducted their own search and they discovered that the investors his client was supposed to have extorted money from were actually fictitious figures who never existed in real life.

He added that they contacted the authorities in the US and Korea where the investors are supposed to have come from and it was realized these were fictitious figures who the investigators of state house anti-corruption unit simply used to open up trumped up charges to provide cover for their allies in New Vision to be able to write fake news stories in order to destroy Balondemu’s reputation as a lawyer in Kampala simply because they wanted to destroy him infront of the president.

Kamba also called out the DPP to guard against those determined to keep using her office to abuse powers the law gives her under article 120 of the constitution. Kamba thanked the magistrate for directing the DPP to stop sanctioning charges before being satisfied by police that investigations have been completed.

This will avoid the DPP office being used to persecute innocent Ugandans, Kamba explained. The magistrate directed that police should only arrest suspects after investigations have been concluded to avoid the abuse of court processes and using the judicial system to persecute innocent citizens of Uganda.

“They said in October last year that they had full evidence to prosecute Dr. Balondemu but they have ended up just persecuting him which the constitution doesn’t allow. We are going to sue the state in civil courts and get damages to compensate for this persecution” Kamba explained to reporters as his client smiled from ear to ear.

In the same ruling, the magistrate condemned the state for holding on to Balondemu’s personal property which was never part of the exhibits for the mistrial. These included his personal vehicle, his passport, wallet and mobile phones. The magistrate directed that all these be unconditionally returned to Balondemu because they are his property.

Kamba said they are going to use civil remedies to sue the state under the tort of detinue for the wrongful and unlawful detention of chattels. The latest city hall ruling now means that Balondemu is free a long with his co-accused Eric Mukwa.

On his part, Museveni had long realized that all these were fabricated charges and this was after his private investigators led by Susan Kasingye reviewed everything and concluded that Dr. Balondemu was just being mistreated as a victim of machinations of Kampala mafia actors who got angry when he advised the president not to endorse the billions of shillings that was supposed to be paid for Owino land which was already public land owned by the gov’t of Uganda.
