The High Court has extended orders stopping Businesswoman Dorcas Joan Kiptoo from interfering with a parcel of land situated in Karen that is worth Ksh.4.6 billion.
This is even as a new application has been filed in court seeking to have Kiptoo cited for contempt of court orders.
During Monday’s hearing before Justice Ogutu Mboya, the court was told that Kiptoo has disobeyed court orders issued on March 8, and that the respondents in the matter have gone ahead with fencing the property.
Similarly, the court was told that the police have failed to abide by orders and urged the court to hear the contempt application before hearing other matters.
”The last orders were very clear …the OCS Karen were to help in enforcement of the orders …they have failed to abide by those orders of the court …then the contempt application should be heard first …the contempt is continuing to fence off the land ,” court was told.
“They are protecting the person’s defendants. We are inviting the court to visit the land in dispute and then give directions and give orders,” court heard
In the application, Arvind Kanji Patel claims there is a willful and deliberate disobedience of the court order by Kiptoo, the Sub County Police Commandant, Karen and the OCS Karen Police station.
“…..that it is essential for the court to commit the contemnors to jail to compel obedience of the court order,” reads court papers.
The judge directed that the application be heard on May 6 this year and directed parties to file and serve their respective papers and submission within 7 days.
