KEMSA Chairman Irungu Nyakera’s Linked Firm on Radar As Victims of Samara Housing Project seeks Refund

Sycamore Pine Limited, a land selling company directed by KEMSA Chairman Irungu Nyakera, is under investigation as victims of the halted Samara Housing Project demand refunds.

The project, recommended to buyers by Safaricom Investment Company (SIC), has unveiled a complex web of fraudulent dealings and fake promises on the refund of the money paid by investors.

In 2020, Safaricom Investment Company signed a deal with Sycamore Pine Limited, expecting a 4.5% commission for every unit sold.

However, the agreement collapsed when it was revealed that Sycamore lacked essential documentation for the Samara Estate Development project.

The project stalled in 2021 after Migaa Estate residents opposed high-rise apartments, leading to Safaricom Investment Company terminating the agreement.

The first alarm on TikTok was raised by Maryanne Njoki, exposing Safaricom’s misleading practices that prompted investors to join the project without proper due diligence on the company.

She highlighted that Safaricom had misled investors into committing to the project without conducting proper due diligence on the company. She had urged Kenyans to boycott the company and stop investing with them.

In response, Safaricom allegedly attempted to salvage its reputation by urging Maryanne Njoki to delete the viral TikTok video. It was only after such efforts that individual investors began receiving their refunds.

Sarah Wahogo, the CEO of Safaricom Investment Company, recently testified before the National Assembly’s Finance and National Planning Committee, revealing that the approval of the developer’s documents took longer than anticipated.

Following the contract termination, the company held multiple meetings with eight victims to facilitate a refund of Sh10.152 million. By October 18, five victims had received a combined refund of Sh6.158 million, with the remaining three slated to receive Sh3.994 million.

However, individuals who made separate purchases face obstacles in securing refunds, leading to increased demands for transparency and accountability.

The disclosure by Wahogo suggests that buyers who transacted through Safaricom Investment Company have been refunded, safeguarding the company’s image.Susan Wanjiku Kimani revealed to the media that she invested a significant amount of Sh 1.35 million in Sycamore Pine Limited.

However, her endeavors to obtain a refund have been met with frustration.

Kimani mentioned that, since 2020, after making the second installment payment and submitting her signed documents to the company’s offices, she has not received any signed documents from their end.

Additionally, the company has not provided her with a sale agreement or a receipt for the second payment, despite her numerous emails to their lawyer, Sylvia Kimani.

Kimani expressed her difficulty in acquiring the sale agreement, stating that she has been led in circles by office administrators. Even reaching out to KEMSA Chairman Irungu Nyakera, who also serves as the company director, has proven unproductive.

“In my purchase, I never received a signed sale agreement from Sycamore Pine Limited, so technically, it wasn’t a complete sale. All I need now is my refund,” she emphasized

Copies of letters sent to Sycamore Pine Limited and emails directed to Irungu Nyakera, Jmwenje, Fkigen, and Evans, as seen by this publication, illustrate Susan Kimani’s persistent attempts to recover her money without success.

Another victim, using the alias Nancy Mwangi, highlighted her direct deposit of funds into Sycamore Pine Limited’s account, linking the fraud to collusion between company directors, office administrators, and sales agents.

She called for Irungu Nyakera’s resignation, citing a violation of Chapter 6 of the Kenyan Constitution on integrity.

She said that they were duped to directly deposit at least 20 per cent of funds into the Sycamore Pine Limited account.

“Kemsa Chairman Irungu Nyakera is the director of the company that tricked us to fall into fake project and he seem not ready to refund our money despite numerous push and he seem to ignore those who bought separately from cooperative, all what we need is our money or he resigns from his position on the ground of chapter 6 of the Kenyan constitution that talks of the integrity,” she said.

Nancy emphasized that the government should suspend and deregister the company to shield Kenyans from financial losses adding that affected buyers are urging the government to take swift action against fraudulent companies to safeguard citizens from exploitation.

Another buyer with Sycamore Pine Limited who sought anonymity for fear of being frustrated on getting his money back said that the government should registrate mushroom land selling companies that have embraced the culture of conning Kenyans.

He said that his relationship with Sycamore Pine Limited is frustrating noting that he has visited the company offices without help noting that they are not functional and the staffs seem to ignore anyone demanding a refund.

They have resolved to hold a mega demonstration, and numerous lobby society members and influential individuals have pledged to join if Nyakera fails to settle the refunds.

He said that during demonstration they will mount more pressure by collecting signatures for Irungu Nyakera’s resignation as the Chairman of KEMSA.

“We have resolved to hold a mega demonstration and hundreds of lobby society members and influential individuals have agreed to join us if Nyakera will not have paid us our money, we will push for his resignation as the Chairman of the Kemsa,” he said.

The affected buyers are also calling on the government to enact stringent policies to protect citizens from exploitation by land firms.

The Ministry of Lands recently reported 7,052 cases of property fraud, exacerbated by collusion with professionals.

The Real Estate Stakeholders Association, comprising over 100 firms, was recently formed to combat fraudulent practices and advocate for the prosecution of companies involved in sham land deals.

Chair of the Association of Real Estate Developers, Kinyua Wairatu, urged the government to investigate real estate fraud cases, especially those involving criminals posing as property owners, targeting innocent Kenyans, particularly those residing abroad.

“Some of the companies have closed down and rebranded to new entities unknown to their investors after conning them millions of money,” Wairatu had said.

Eunice Macharia, Chairperson of the Real Estate Agents Registration Board, also recently revealed that companies previously involved in dubious land deals are rebranding to re-enter the market.

She has sought police assistance to investigate the escalating cases of fraudulent land deals, urging the DCI to commence investigations into recent fraudulent activities by land-buying companies.

“We urge the Directorate of Criminal Investigations (DCI) to commence investigations on cases of fraudulent land-buying companies that have happened in the recent past,” she added.

PAUL MUGOYA: Without Term Limits, Elections Are A Vehicle To Justify Continuous Stay In Power

The future of Uganda lies with the NRM government. It is only NRM that will determine the future of our country because they are the ones holding power unless otherwise. They can either make or crush the country. The power and the prerogative to make good decisions are with them.

Already, the development partners are signaling fatigue with the present leadership because of corruption, increasing personalization of power by the President, and abuse of human rights. All of the above-mentioned are contradictory to the aspirations of the Revolution.

The original intention of the Revolution was not to make President Museveni a life President. The intention was to make NRM the dominant Party. Unfortunately, Mr. Museveni has been compromised by power. He thinks he is too good to go.

Patrice Lumumba of Congo once said, “Times are good things. No matter how good a dancer you are, you must leave the stage”. Previous leaders made mistakes. “Two wrongs don’t make a right”. Let us give the young ones a chance to govern themselves and we give them guidance. President in his early times won worldwide acclaim because he was clear-headed socialist and focused with a frugal mind .

At that time he wouldn’t have allowed corruption to prevail and thrive as it is today. Today, he has a changed mind. A capitalistic mind of exploitation and subjugation. He recently said corruption is good so long as they don’t take the money outside the country. But forgetting that corruption is a vice which has an element of criminality and exclusion.

Now look at our Air Force planes crashing almost on a monthly basis, this because of corruption. Purchasing not airworthy goods for the Air Force will not sustain our air defense system in case we are in war, ‘enjawulo.’ These planes are falling down like stones because of corruption just as Gen. Muhoozi once mentioned that there is unchecked corruption in the Ministry of Defense.

In the earlier times, he had very good intentions because he had wanted to sanitize the governance and politics of Uganda which was a well thought idea. Unfortunately, instead today, we are reversing backward. It wasn’t the intention for NRM to perpetuate an individual into power but what I know, NRM came to stay. What one sows is what you rip.

The overstay of Mr. Museveni in power will have serious implications to the country. His continuous stay in power is bringing diminishing returns to the country. NRM should not dance that NUP does not have plans. This is just cheap propaganda. The moment NUP is allowed a democratic space to freely mobilize as the Constitution provides, NRM will realize what I’m saying.

NRM has gone off track betraying those who died during the struggle and we who are still breathing, that NRM has not seen other people within the Party allowed to challenge Mr. Museveni for the Presidency. Why should we deny other competent young individuals an opportunity to have a shot at the Presidency and allow the country share with them their potentiality.

President Museveni has let down the country on corruption, democracy, employment and service delivery. This is looking ugly. Look at Kampala city now, look at the paralysis that has hit other cities and administrative units. He said this himself, that Kampala is rich in potholes. And this comes from horses’ mouth himself, the gentleman who should be himself responsible to correct the mess as the Chief Executive for Kampala city.

Democracy:
In many cases, and more particularly in developing and underdeveloped or least developed countries, democracy is not real. The democracy practiced in such countries is fake. Given our culture, it is difficult to practice exactly the West Minister House of Commons style of Democracy.

Secondly, we are yet to transition from militarism. Elections here are cajoled and ritualized, and in most cases there is State-inspired violence. Ordinarily, democracy is the observance and respect of the separation of powers in the governance of the people. Unfortunately, some leaders manipulate the system to favor their continuous entrenchment in power. Some leaders are themselves all over dominating the three arms of governance. They have become the Alfa and Omega of governance. These

Elections are conducted to allow people to have a choice of their leaders. But in most cases, these elections are rigged in favor of the incumbents where levels of transparency are questioned. To some extent, elections are commercialized, and militarised. These elections are normally held in a repressive, violent environment, where voter intimidation is rife.

In these circumstances, opponents and their supporters are seen as enemies of the State. People are even maimed or killed by the security forces, like what happened in the elections in Uganda and Kenya. In Uganda, some elections have been conducted like war, an example is the 2021 general election.

This has resulted in a lack of trust in elections, where voters have started to lose voting interest. There is growing voter apathy. Partisan elections in these parts of the world are divisive and polarising. Even the elections in DRC are far better because the term limit is entrenched in their Constitution.

There is a need for the term limits to be reintroduced, and revert to individual merit. This system is a suitable model for holding the nation together. Term limits are good for checking out leaders who can become parasitic to the national coffers and a liability to the taxpayers.

Currently, the Electoral Commission is not Independent and transparent. There is much interference from the State. Because most times it serves the interests of the incumbent who at the same time is a competitor which is a conflict of interest. When it comes to releasing the outcome, results are delayed with no formal communication to explain the delay.

At times the internet is switched off, disabling information flow, making checks and balances difficult. This puts the voters in total darkness which raises the suspicion of rigging in the eyes of the voters. There is one thing that has escaped the minds of the leaders.

That the results are owned by the people, and that the only function and responsibility of the government is to ensure that the elections are conducted in a free and fair manner and to ensure the protection of the voters and their votes plus an orderly delivery of results in a transparent civilized manner.

Challenges In Democracy:

1. Lack of an independent Electoral system.
2. Militarisation of elections.
3. Commercialization of politics.
4. Interference from the Executive.
5. Lack of transparency and accountability by auditing of the results.
6. Delayed opening of polling centers and distribution of election material.
7. Failure to procure proper voting machines at the right optimum time.8. The domination of the electoral process by the Incumbent. This has far negative reaching consequences on the outcome of elections.
9. Partisanship; partisan politics is divisive.
10. Huge Parliament; is as lame as a sitting duck.
11. Revolutionary cadres have been abandon and left to age and rot in poverty.
12. Those who were the enemies of the Revolution are the ones now in charge.
13. Intrigue, discrimination, corruption, nepotism, greed, bigotry etc. have consumed nationalism and patriotism.
14. Wastage; opulence in an ocean of poverty.
15. Patronage; political patronage is rife for regime survival.
16. After 40yrs in power what do we expect after this term. By now all regions should have been transformed.

Way forward:
There is a need to make electoral reforms by a bipartisan approach. An independent Electoral Commission should be appointed by a Judicial Commission with representatives of political parties.

NB: A reminder for those who didn’t know, President Museveni stood for freedom and liberty plus transparency and the restoration of sanity and orderly governance. This became the pinnacle that shot Mr.Museveni into the lime light making him shine as new breed of African leaders.

Mr. Museveni was among the top most 5 highly regarded and respected African leaders but it was also with the support of the people. Mr. Museveni has very high IQ and he is a very good strategist. Unfortunately, he is a bad implementor and manager and has failed to implement and enforce his strategies.

There is a saying that, longevity in power and age makes one become kind and soft to his supporters, that even if they made serious mistakes he is blind to see them. Unfortunately, he has never been kind and generous to us who stood with him since the early times when he was not the President.

I wish he retired peacefully and see him sitting under the canopy of a tree shade watching over those beautiful Ankole cows with a peaceful mind. My humble request to the President is, build an airport and 7 star Hotel for the Elgon region to promote tourism in memory of the FRONASA struggle.

This will also connect us directly to the international business world. Secondly, merge the PDM program to the cottage industry by popularizing milling of sunflower cooking oil as thriving product by introducing Oil Milling across the country.

Ugandans Required To Present Old National IDs Before Getting New One’s Ahead Of Mass Renewal

The National Identification Registration Authority (NIRA) has said it is mooting a plan to have all Ugandans present their old national IDs before being issued new ones during the forthcoming mass enrollment.

The registrations body is set enroll Ugandans for new National IDs with new features including DNA but all this yet to be approved. Having done the mass enrollment and registration in 2014, the current National IDs will be expiring starting this year hence the need for mass renewal.

Addressing journalists in Kampala, NIRA spokesperson Osbone Mushabe says they are mooting a proposal that before issuing the New IDs, Ugandans will have to present the old one and if one is found without an old ID, will have to pay Shs50,000 to get the new one.

Mushabe says that record have indicated that a number of Ugandans have either lost, misplaced or used their national IDs as security to acquire loans from money lenders and have not bothered to get them back or replace them.

“It is important to know that it is very risky for any citizen out there not to be having a national ID at this moment yet it is crucial in accessing key government services or even other services like banking among others”-said Mushabe
“Our Maiden Call to all Ugandans who lost their national IDS to have them replaced as soon as possible to avert any challenges that may arise during the mass renewal exercise since the old cards will be required for one to get a new one”-he further stated.
He however says the proposal awaits approval from the authorities.

How Gov’t Spent Billions In Paying Ghost Workers

The Auditor General John Muwanga has handed over his report for the financial year ending at 30th June 2023. In his report, he highlighted several areas of concern which are making government loses billions.

According to the Auditor General, during the audited financial year 2022/23, government spent Shs53billion in paying salaries to over 10,192 workers who were inexistent, some were dead, retired or absconded from duty.

“The Auditor General recommended the recovery of Shs53Bn from 10,192 ‘ghost workers’ who had been Gov’t payroll, but during the verification exercise in February 2023, these were found to have died, retired or absconded from duty”-indicated the AG

Whatever you think is impossible, is actually possible in Uganda, dead people receiving salaries on their accounts sounds too crazy but true. This maybe could become history after the Auditor General’s Office did a countrywide audit of the salary payroll across government.

REVEALED: Five Top Gov’t Universities Now Teaching Expired Courses

When you hear of expired courses being taught Uganda’s Universities, it throws those who graduated in a frenzy of panic and uncertainty but now it seems studying expired courses is becoming the new normal in the Pearl of Africa.

Having thought the mess was resolved last year after the public uproar over the word EXPIRED COURSES, the same word that sounds bells of fear and panic is back to haunt five public universities which continue teaching a whooping 222 expired courses to their students.

While handing over his audit report for the financial year ending June 2023, the auditor general separately revealed that five public universities are offering their students expired courses.

“Analysis of programmes from 5 Universities revealed that out of the 629 programmes, only 332 were accredited, 138 had been sent to NCHE for accreditation, while 222 were not accredited,” read in part the report.

He revealed that Makerere takes the lion’s share in teaching expired courses with 120 courses expired, followed by Kyambogo with 63 expired courses, Mbarara University with 21, Makerere University School with 15 and Gulu University with 3.

Accreditation of courses taught in both public and private Universities is a reserve of the National Council for Higher Education headed by former Busitema University Vice Chancellor Prof Mary Okwakol. It remains a question of who, why, what and when will this mess be fixed as it is set to affect employability and also affect those who want to upgrade their education in foreign universities.

This comes at a time when Nigerian government declared it would soon declare degrees got from Uganda and Kenya by their citizens null and void claiming the same are becoming rampant with fake degrees.

Uganda’s Appetite For Loans Pushes Public Debt To Shs96.68Trillions

Following the enactment of the Anti-Homosexuality Act 2023 by the Ugandan Parliament and signed into law by president Museveni. There was uncertainty on what the future holds as Westerns powers went on rampage showing unhappiness over the new law in Uganda that comes with tough punishments including a death penalty, life imprisonment and huge fines to those convicted.

Upon learning that the Anti-Homosexuality Act has been signed by president Museveni, US president Joe Biden in his strong worded statement warned that Uganda would face it rough if the new law is not repealed.

In his statement, Biden threatened of tough economic sanctions, visa sanctions and Uganda would lose its membership in the lucrative AGOA business forum which is a gateway for Uganda’s products to the American Market and also a line of investments from the US.

As of today 9th January 2024, Uganda remains in a fix and not certain what more the Western powers have in stock for the Pearl of Africa as the World Bank suspended funding to Uganda last year in October.

Following the announcement that no more funding will be accepted from Uganda by the World Bank, a visibly disappointed Museveni hit back at the funding agency for using money to coarce African countries into accepting such indecent behaviors which undermine the African culture and values.

Museveni would later reveal that some technocrats would go borrow money even when it was not needed until he took over the process and no loan is now taken without his authorisation.

In December, Parliament approved loans worth over Shs6.868trillion to fund a supplementary budget; construction of e-government infrastructure and implementation of climate smart agriculture projects and media would later report in January that government borrow Shs7trillion in 7 days.

According to the State of the Economy report released by Bank of Uganda in December 2023, debts continue to pile a lot of pressure on tax revenues.

“Although recurrent expenditure also underperformed the budget, interest payment overshot the budget by Shs55.5 billion reflecting high interest rates amid tight financial conditions”, the report reads in part.

“Interest payments and external principal repayments exert elevated pressure on tax revenues to the extent that for every 100 shillings collected in tax revenues, 32 goes to debt service, diminishing resources available for service delivery” the BoU report observed.

While handing over his audit report for the financial year ending on 30th June 2023 to the speaker of Parliament, the Auditor General revealed that Uganda’s total public debt as at 30th June 2023 stood at Shs96.168Trn, comprising of domestic debt stock of Shs43.696Trn and external debt stock of Shs52.472Trn, with the report noting that Uganda’s debt in five years has increased by 107%.

The mandate to accredit courses offered and taught at both Public and public Universities in Uganda is with the National Council for Higher Education currently headed by former Busitema University Vice Chancellor Prof Mary Okwakol.

NCHE would later come out to clarify after both public and private Universities demanded for explanation pushing blame to the accreditation body for delaying to renew such courses hence being referred to as expired courses as the same remained on their website.

NHCE also called upon Universities to officially have the courses they offer to their students be re-evaluated and accredited as this is supposed to be done every after two years and all students mostly in Private Universities pay a fee dubbed NCHE fee which ranges between Shs10,000 to Shs20,000 every semester through out their time at university.

Now while handing over his audit report for the financial year ending on 30th June 2023, the Auditor General John Muwanga has revealed that five public Universities in Uganda are reaching a total of 222 expired courses. The Universities include Makerere with 120 expired courses, Kyambogo University with 63 expired courses, Mbarara University of Science and Technology with 21 expired courses, Gulu University with 3 expired courses and Makerere University Business School with 15 expired courses.

The ministry of health was on Sunday dealt a huge blow after two of it’s top employees died this past Sunday. One died in a motor accident in Bweyale along the Kampala-Gulu highway while another was murdered in Masindi.

The deceased are Dr James Eyul who was serving as the aviation/airport health boss at Entebbe International Airport while the other is Dr Jino Abiriga who was serving as the District Health boss for Masindi district.

Dr Jino Abiriga was murdered on Saturday and his lifeless body was found lying outside his home. Facts so far gathered by police indicate that on Saturday, the victim left his home in the morning to attend a friend’s wedding. After the wedding, his driver dropped him back at his home at around 9pm. And at round 10pm, he and his wife, Cherotic went to sleep in their double roomed house. Their Children and dependently who included; Aseru Angera aged 17 (daughter to the deceased), Cherotic Maureen, aged 14 (step daughter), Cheprotich Keneth, aged 11 (Step son, Afakoru Jackline aged 12 (Niece) and Arinaitwe Desire aged 8 (daughter to the deceased’s friend) also went to sleep in their separate unit which are enclosed in a fence.

The victim according to his wife was called to go and do an operation on a patient and never returned and according to police spokesperson Fred Enanga, his lifeless body was found with a deep cut on the neck, multiple cuts on the head just 50 meters away from his home. Police has since detained his wife and other suspects to help in the investigations.
