Fighters from Somalia’s Al Shabaab insurgent group attacked a military base on the outskirts of a town in the centre of the country, leading to at least 17 deaths, a resident said.
The attack on Masagawa, about 300 km (190 miles) north of Mogadishu, came days after Al Shabaab attacked a base housing Ugandan forces from an African Union peacekeeping mission in Bulamarer, 130 km (80 miles) southwest of the capital.
“I have seen 17 dead people including the attackers and the attacked. The fighting has moved into the forest. The town is calm now and under government control,” Hussein Nur, a resident of Masagawa, has said.

Captain Abdullahi Mohamed, a military officer in Masagawa, confirmed the attack and said 12 al Shabaab fighters had died, but he did not know how many troops were dead.
“Fierce fighting went on for hours on the edge of the town. So far, I know we lost soldiers but I have no exact figure. We repulsed al Shabaab and now we are pursuing them in the forest,” Mohamed told Reuters.
The Somalia National Army said on Twitter it had prevented an attack on the town itself, and killed al Shabaab fighters, but did not say how many.
Al Qaeda-linked al Shabaab has been fighting since 2006 to topple Somalia’s central government and establish its own rule based on its strict interpretation of Islamic Sharia law.
It has launched significant attacks against hotels, military bases and government establishments in despite a relatively successful government push back.
The group said in a statement it had killed 73 soldiers in the attack, targeting those who had returned from training in Eritrea.
Al Shabaab tends to give casualty figures in attacks that differ from those issued by the authorities.

The terrorists ran over an ATMIS base in Buulo-Mareer town approximately 120km south East of the capital Mogadishu, the over 800 terrorists caught the base unaware on Friday last week leaving many UPDF soldiers dead, several injured and scores taken as Captives. The militants issued a statement and claimed the killed 137 UPDF Soldiers and took several as captives.

President Museveni issued a statement vowing that the terrorists will regret attacking the UPDF base, he however attributed the attack on poor equipment at the base. Museveni also revealed that his UPDF boys panicked something he says might have enabled the terrorists to destroy the base.
Museveni further says UPDF bosses sent soldiers who were not fit for the frontline in Somalia or they were not prepared for the mission, he also lashed at the Americans and Turkish drones for not swinging in time to save the situation.
The UPDF back in Uganda and the ATMIS headquarters in Somalia all remain tight-lipped on the number of causalities, those injured and also those taken as captives by the militants despite calls by relatives of those in Somalia to know the whereabouts of their sons and daughters in Somalia.
In the evening of yesterday, the ATMIS force Commander Lt Gen Sam Okiding visited the injured soldiers who sustained injuries during the attack and wished them quick recovery. These are receiving treatment at the ATMIs level II hospital in the capital Mogadishu.
Okiding commended the injured soldiers for the bravery they exhibit in fighting the Al-Shabaab militants. He also extended his condolence message to the families and relatives of the UPDF soldiers who died during the attack.

UPDF has since sent sent the Commander Land forces Lt Gen Kayanja Muhanga on a fact finding mission to Somalia to ascertain how the attack happened and any other information regarding the operations of the UPDF in Somalia. It’s been reported that a curfew has been announced in the areas where Al-Shabaab used to run over the UPDF base in what might come out as the biggest in terms of fatalities ever since Uganda deployed in Somalia in 2007.

These are two different types of agreements that govern the legal relationship between parties involved. Contract of Service.
A Contract of Service, also known as an employment contract, is an agreement between an employer and an employee. It establishes an employer-employee relationship where the employee agrees to provide personal services under the control and direction of the employer. The employer has the right to determine the work to be done, how it should be done, and the tools or equipment to be used. This type of contract typically involves a degree of subordination on the part of the employee.
Major characteristics of a Contract of Service Include
Control and Direction: The employer exercises control and supervision over the employee, providing instructions and guidance in performing the assigned tasks.
Personal Service: The employee is expected to personally perform the agreed-upon work and cannot readily delegate it to someone else.
Employer’s Responsibilities: The employer assumes certain obligations, such as providing a safe working environment, paying wages, and offering benefits in compliance with labor laws.
Termination: The termination of a Contract of Service may involve specific notice periods, severance pay, or other legal considerations, as governed by employment laws.
Contract for Service
A Contract for Service, often referred to as an independent contractor agreement or a consultancy agreement, is a legally binding agreement between a service provider (contractor) and a client (principal). It engages a contractor to perform a specific task or provide a service, but they retain control over how the work is carried out.
Characteristics of a Contract for Service
Independent Work: The contractor has autonomy and control over the methods, tools, and timelines required to complete the agreed-upon task.
Service-Based Agreement: The focus is on the results or outcome of the work, rather than the direct control exercised by the client.
Payment and Obligations: The contractor is responsible for their own tax obligations, insurance, and other business-related expenses. Payment is typically made upon completion of the task or as per the agreed-upon terms.
Non-employee Status: Independent contractors are not considered employees of the client and are not entitled to the same benefits or protections under labor laws.
How important is it to know the difference?
Distinguishing between a Contract of Service and a Contract for Service will help you determines the rights, obligations, and legal responsibilities of the parties involved. Misclassification of a worker’s status can lead to potential legal issues, such as claims for employment benefits or disputes over tax liabilities. Properly categorizing the relationship between parties helps ensure compliance with tax and labor laws and provides clarity regarding the rights and obligations of both parties.
The tax implications of a Contract of Service (employment contract) and a Contract for Service (independent contractor agreement) can differ based on the classification of the worker and the applicable tax laws in a particular jurisdiction. Here are some general tax considerations for each contract type.
Contract of Service (Employment Contract).
Income Tax Withholding. When an individual is engaged under a Contract of Service as an employee, the employer is typically responsible for withholding income tax from the employee’s wages. The employer deducts the appropriate tax amount from the employee’s salary and remits it to the tax authorities on their behalf.
Social Security Contributions. Here in Uganda, both the employer and the employee are required to make contributions to the National Social Security Fund. These contributions are calculated on the basis of 5% from the employee’s salary and the employer also contributes 10% of the gross pay towards the scheme in favor of the employee. The 5% deduction of the employee’s salary is deducted by the employer before issuing the net pay.
Payroll Taxes. Any additional benefit that accrues to the employee has to pass through the payroll and subjected to tax if any.
Benefits and Allowances. Employees may receive various benefits and allowances, such as health insurance, retirement plans, paid leave, or transportation allowances. The tax treatment of these benefits can vary, and some may be subject to specific tax rules or exemptions.
Contract for Service (Independent Contractor Agreement)
Income Tax: This tax is paid on the profits or earnings generated from self-employed activities. The income tax rates for individuals vary based on income brackets, as determined by the URA. It’s important for contractors to keep records of income and expenses to accurately calculate taxable income.
Local Service Tax: Local governments in Uganda impose a local service tax on individuals engaged in specific service-oriented businesses, including independent contractors. The tax rate and specific requirements vary.
Value Added Tax (VAT): If an independent contractor’s annual turnover from taxable supplies exceeds 150m as set by the URA, you’ll be required to register for VAT. VAT is a consumption tax levied on the value added at each stage of the supply chain. Contractors registered for VAT shall collect VAT on taxable sales and remit it to the tax authorities, while also being eligible to claim for VAT where input VAT credits exceed output VAT paid on business-related purchases.
Pay As You Earn (PAYE): When an independent contractor hires employees to assist with their business operations, they are required to deduct Pay As You Earn (PAYE) from their employees’ salaries. PAYE is an income tax withholding system for employees, and the contractor is responsible for remitting the deducted tax to the URA on behalf of the employees.
Local Government Taxes: In addition to national taxes, local government authorities may impose various taxes, licenses, or fees on independent contractors operating. These can include trade licenses, property taxes, signage fees, and other local levies specific to the area where the contractor conducts their business.

The Directorate of Crime Intelligence, in coordination with KMP and Mukono police, carried out an intelligence led operation on the 24.05.2023, and cracked down an organized criminal gang, that had specialized in the vandalism and theft of spare parts from long distance trucks, lorries and trailers that are parked alongside the road, fuel stations, other parking lots and in vulnerable locations.
Under the pretext of repairing a broken-down truck, they end up removing the spare parts, especially the diff and axles, on parked trucks along the Mukono Jinja highway. The crackdown operation covered areas of Bugembe, Katwe and Nakanyonyi in Jinja City, where an assortment of suspected stolen spare parts were recovered. So far 5 suspects have been arrested and these include; Sendagire Muhammad, Matege Dan, Mukasa Robert, Muhindo Joseph and Jagwe Arthur. A serious manhunt for other members of the criminal gang is ongoing.

NABILATUK: A total of 70,000 people of Lorengedwat, Natapar Arengan and Juju in Nabilatuk district have asked for investigations into the failed water systems that has made several households in the district share water sources with animals.
In the financial year 2020- 2021, the ministry of water and environment released about Shs2billion to Nabilatuk district to construct clean piped water for four trading centers however, all the four systems have failed to work.

The systems are located in areas such as Lorengedwat sub county, Natapar Arengan, Natapar Akwanga and Nabilatuk town council.

Know your statutory rights and obligations as a taxpayer as we welcome the new financial year!

As we come to the close of financial year 2022/2023 and welcoming the new financial year, it is key to note that tax compliance is a major factor affecting tax revenues. To determine the level of compliance of taxpayers in meeting their tax obligations can majorly be seen from the URA’s achievement of set revenue targets.

The Ugandan economy cannot realize a prosperous society without payment of taxes. Many national development is still lacking, even public facilities such as health centers, roads, village and local council offices and other public institutions that need to be repaired.
A few weeks ago, Ugandans on social media platforms started an exhibition of the ailing issues in service delivery beginning with the roads, where they showcased potholes in Uganda’s finest Kampala city and its suburbs, they went on to the health sector and their exhibition is ongoing.
Society seems un-satisfied with the government’s policy in terms of national development. The condition is influenced by so many factors among which disobedience of the taxpayers in the community to pay taxes, a state income tax that in turn gets back to the community in form of public facilities. Many people are still unaware about this. There is therefore need for society to know the role of tax knowledge correctly which is very important for the progress of the economy of Uganda.
Taxation has a variety of laws that have been set in legislation through Acts of the Parliament. Every taxpayer is required to understand all the rules and applicable taxes. Not all tax payers have full access to information.
The URA has done a great job in sensitizing the public about taxes through their programs, and this explains reasons why there is a slight increase in number of registered taxpayers in Uganda because of public awareness and the tax benefits of ownership of Taxpayer Identification Number (TIN).
Uganda follows the self-assessment tax system where by taxpayers, guided by the existing tax laws, determine the taxes due to the URA, proceed to file the relevant returns and make payments where applicable.
Responsibility is shifted to the taxpayer for proper accounting, assessment and payment of their tax liability with limited or no intervention by tax officials. The URA may occasionally carry-out compliance checks to make sure a specific tax return or claim is correct.
I would like to briefly educate you about your rights and obligations as a tax-payer whether you are an individual, or a company.
The Right to Be Informed
As a taxpayer, it is your right to know what you need to do to comply with tax laws. You are entitled to clear explanations of the law and URA procedures in all tax forms, instructions, publications, notices, and correspondence. For example, you receive a notice fully or partially disallowing your refund claim, including a refund you claim on your income tax, VAT return, it must explain the specific reasons why the claim is being disallowed.
The Right to Pay No More than the Correct Amount of Tax
You have a right to pay only the amount of tax legally due and to have the URA apply all tax payments properly. If the URA is proposing to adjust the amount of tax you owe, you will typically be sent a notice which informs you of the proposed change. This notice provides you with a right to challenge the proposed adjustment through objections, the Tax Appeals Tribunal and Litigation, Alternative Dispute Resolution, the High Court, and Court of Appeal.
The Right to Quality Service
As a taxpayer, it’s your right to receive prompt, courteous, and professional assistance from the URA. You have a right be spoken to in a way you can easily understand, to receive clear and understandable communications from the URA officers. There is a suggestions box at the URA for you to file complaints about inadequate service.
The Right to Challenge the URA’s Position and Be Heard
Taxpayers have the right to challenge decisions of the commissioner by raising objections and provide additional documentation in response to formal URA actions. A dispute may arise where the URA, through the commissioner, issues a taxpayer with an additional assessment.
Where the Commissioner makes an additional assessment, the Commissioner is required to serve the taxpayer with a notice of assessment and a decision notice can be any one of the following:
An assessment or amendment to an assessment;
A penalty notice if a penalty is due;
A letter setting out the final position.
A taxpayer who is dissatisfied with an assessment may lodge an online objection with reasons to the Commissioner within 45 days after being served with a notice of assessment.
Upon submission of the objection to the assessment, the Commissioner is required by law to issue an objection decision within a period of 90 days from the date of receipt of the objection. Should the objection decision not be served within 90 days, then the taxpayer objecting may by notice in writing to the Commissioner, choose to treat the Commissioner as having decided to allow the objection.
The Right to Appeal an URA Decision in an Independent Forum.
As a taxpayer, if you are not satisfied with the objection decision of the Commissioner, you can lodge an application with the Tax Appeals Tribunal (TAT), within 30 days from receipt of the decision. The Tribunal was set up by an Act of Parliament as a specialized court to provide taxpayers with easily accessible, efficient and independent arbitration in tax disputes with URA.
The Right to Privacy
The URA in its inquiry, examination, or enforcement action must comply with the law and not be intrusive than needed, to respect with all due process rights to the taxpayer. The URA cannot levy any of your personal property in any situations before it sends you a notice of demand or while you have a request for a payment plan pending.
The Right to Confidentiality
You have the right to expect that any information you provide to the URA will not be disclosed unless authorized by you or by law. Therefore your information must be safe from disclosure to third parties.
The Right to a Fair and Just Tax System
Taxpayers have the right to expect the tax system to consider facts and cURAumstances that might affect their underlying liabilities, ability to pay, or ability to provide information timely. Taxpayers through the Tax procedures code (amendment) bill, 2023 under “40D Waiver of interest on payment of principal tax
The Commissioner shall waive the payment of interest and the penalty by a taxpayer, where the taxpayer voluntarily pays the principal tax outstanding at 30th June, 2023, by 31st December, 2023. This is a good one for a taxpayer who would wish to clear and reconcile their ledgers with the URA.
Much as you have your rights as a tax payer, you have obligations that you must fulfill as a good citizen of Uganda to enable government do its role of service delivery. Among the many obligations you have, I explain a few below for your attention.
The obligation to file and pay taxes on time
Just like all tax systems around the world, you are required to pay your taxes on time. Late payment of government taxes expose your business to risks, being listed and monitored as a high risk tax payer, penalties, and interests that come thereof. Note there are monthly taxes like VAT, PAYE, NSSF WHT where all taxable persons are required to file a return for every tax period within 15 days after the end of the month.
The obligation to keep records
You are supposed to furnish returns based on accurate information to the revenue authority. As a taxpayer you should keep reasonable periodic records of your financial transactions. Such records help the revenue authority to verify that the information provided is accurate.
A side benefit is that record keeping also makes good business sense and will enable you in financial planning and decision making, increasing their likelihood of success. The URA has assisted in this with the introduction of EFRIS which is now used from small, medium to large business taxpayers. Failure to keep records comes with a huge penalty that may cripple your business.
The obligation to be honest
You are supposed to embrace honesty in your tax dealings and transactions. Suppose most taxpayers did not pay their taxes, the tax system would be placed under a severe compliance strain and GoU wouldn’t have be unable to finance the expenditures as voted for by the citizens. Taxpayer honesty is fundamental to the operation of tax system. Failure to exhibit honesty gives the URA investigatory powers with penalties and sanctions in place to cater for instances where there is non-compliance.
The obligation to be co-operative
Modern tax systems world-over function effectively where there is a high degree of voluntary compliance, keeping the need for enforcement activity at a minimum. Co-operation of taxpayers allows the government to run the taxation system at a relatively low cost and minimizes unnecessary intrusion into taxpayer affairs by the URA and those of third parties.
The obligation to provide accurate information and documents on time
The URA uses information provided by taxpayers to identify the taxpayer and their address and to account for taxes paid or payable. Thus, as a taxpayer you should provide accurate information to revenue authorities.
The tax procedures code (amendment) bill, 2023 provides for taxpayers providing the required information to the URA for conflict resolution before going to the Alternative dispute resolution procedures. Taxpayers must be therefore keen with information provided, and should be provided at the needed time.
Have you been part of the unaware group of taxpayers who didn’t know their rights and obligations? The right time to start is now! In the tax system, taxpayers must obey the tax laws. There’s an important legal principle that says “ignorance of the law is no excuse.” You can’t defend your actions by arguing you didn’t know they were illegal, even if you honestly did not realize you were breaking the law.

It is gratifying to learn that President Tibuhaburwa Museveni has signed the Anti-Homosexuality Bill 2023 into law. I support Hon. Asuman Basalirwa’s advice to Government that to offset the effects of countries that approve of Homosexuality retaliating with reduction of Foreign Aid (which is actually robbery from the poor by the rich because far more money flows out than comes in as as foreign aid) that:
1. We rethink the current over expenditure or wastage of public money on non-essential sectors and activities, and instead redirect the money into education, health and other essential sectors and activities. This is possible.
2. That Government considers making the Arab world as the alternative source of foreign funding of its programmes, projects and strategies in development.
Of course human rights organisations and those who support or practice homosexuality will go to Court, perhaps not to overturn the law. But they will have to prove that homosexuality is a human right and not a human wrong.
The West would not accept if our popular practice of polygamy was imposed on its people, but it finds it befitting to impose homosexuality in African countries 8n general and Ugandà in particular.
We can say this 8s 4he new imperialism of influencing our countries by interfering with natural sexuality via homosexuality. It is terminal seeds, which cannot recycle life but terminate reproduction.
Indeed homosexuality is an antithesis of human reproduction since it is hinged on anal sex (among males mainly) and women acting as man and wife. Unfortunately increasingly adult homosexuals are turning to the youth and very young children to quench their homosexual desires.
