OWEYEGHA-AFUNADUULA: The Role Of Universities In Knowledge Integration And Re-integration

When I retired from the world of academics in 2009 and from the world of organized public civility as the topmost civic leader in the Nile Basin region, where I was the Chairman of the Nile Basin Discourse (NBD) – a non-governmental organization (NGO) for 11 countries (i.e., Burundi, Democratic Republic of Congo, Egypt, Eritrea, Ethiopia, Kenya, Rwanda, South Sudan, Sudan, Tanzania and Uganda) in 2010, my head was full of knowledge why our African countries are finding it difficult to unite and integrate themselves politically, economically and socially, or conserve their environments as one.

From what I learnt I concluded that the collective African mind is a greatly split mind. It has been split by imposed education imposed by centuries of colonialism and neocolonialism. I also concluded that the tendency by rulers of Africa who spend time, energy and money to stay in power as long as they want and accumulate wealth as much as they can is confounding the problem.

To stay in power as long as they can, they have had to subdivide their countries as much as they have found fit geographically, economically, ecologically, socially, environmentally, intellectually and politically. They found the African elite mind already split through years of academic education in small pockets of knowledge, and conditioned to be selfish, undemocratic and easily amenable to manipulation and to being anti-liberation or anti-emancipation. Using money, often dishonestly obtained, the rulers have been able to confuse the elite to work in their favour of keeping their countries ununited and unintegrated in order for them to rule perennially.

Or lese they have maintained a state of insecurity to justify why they should spend a lot of money on security issues away from social matters, namely education, health and education. This way they have to impoverish the poor and needy further and commercialize poverty for political gains, especially during elections, which they must win. The valley between the rich and the poor has never been any wider than when it was when African countries supposedly obtained political from their former colonial masters.

For lack of commitment to true freedom and democracy, many rulers of Africa have facilitated re-penetration of their countries by their former colonial masters and the newer economic and political forces of USA, Russia and China.

They have allowed their universities to continue as if they are still manifesting in the colonial times. To meaningfully and effectively achieve continental or regional unity or integration, there must be a cluster of universities structurally and functionally oriented towards integration. However, many African universities are not much different from the 20th century university, which was structurally and functionally designed to separate learners and graduates from their traditional societies, and to prepare them for crude exploitation and domination.

Just as in the past, it is difficult to use the products of our universities as agents in the great project of uniting our countries and our people nationally, regionally and continentally. It is easier to recruit our elite population in schemes such as robbing natural resources, torturing the poor and needy, and selling traditional lands to foreigners than in uniting or integrating a country or region of Africa.

This is a true African reality. Yet people nurtured that way are the ones found dominating national, regional and continental integration schemes. Meanwhile our universities continue to produce many of them.

A movement for the reintegration of knowledge is sweeping across the globe. Many University campuses globally have accepted that it is too artificial to continue sustaining separate knowledges in one academic environment.

Africa, however, as I have already shown is lagging behind in the knowledge reintegration movement, although most of the societies of the Continent remain far more integrated than elsewhere in the world. This is hurting the Continent’s craze for unity and integration, let alone meaningful development, transformation and development, and security of future.

Apparently, there is gender imbalance in the knowledge reintegration movement, women, such as Bammer, Klein and Lyall, dominating it. Indeed, women tend to be more holistic in their approach to life and knowledge. For example, in Africa, it was women who innovated most cultivated crops, domesticating them from the forest through indigenous biotechnology at the edges of forest and Savanna.

This way they connected human settlements to the forest. Today policies made by men-dominated governments are disconnecting humans from the forests and then devising strategies of forest management that are making them ever more vulnerable to greed and selfishness of men and their corporations.

Only a spirit of integration can revitalize indigenous knowledge and sciences, which were dominated by women of Africa., and rebond today’s cultures with scientific thinking. Universities can indeed lead in this rediscovery, but they need to accept that knowledge integration and reintegration is the way forward in the 21st century and for them to survive in the century of new knowledge, information and communication. Women, who are already at the forefront of reintegrating knowledge, need to be hired from other universities elsewhere to help our women take the lead once again as they did in the past.

It seems, without being active in the knowledge reintegration movement we would be making little progress in the struggles for critical thinking, critical analysis and citizenship, social justice, democracy and freedom, building, all of which are highly essential this century.

Already, the ongoing civic engagement movement, which has been unfolding on the continent of Africa despite the excesses of the rulers, has revealed that mind liberation is possible. Universities can rediscover themselves if they open up to integration and reintegration of knowledge to ensure that our graduates are liberated enough mind-wise to be able to be open enough to engage in critical thinking, critical analysis and citizenship, social justice, democracy and freedom building meaningfully and effectively.

Most resistance to the knowledge reintegration movement is by men who have reached the level of professor in their disciplines. These days they are referred to as “the slow professors” because they are not pen to knowledge reintegration.

They prefer to continue with disciplinary education and research in the century of knowledge reintegration because that is where they think, believe and are convinced they are safest so long as they continue to be academically productive. However, by sticking to this stance, they are in the long run making their universities and their graduates insecure. Even if rulers say they are committed to securing the futures of all citizens, they will be helpless when faced with graduated wrongly trained for the century

It is already obvious that our young people are mis-trained by their professors and lecturers for an employment market that requires graduates at all levels of education that are broad enough to fit in and benefit in newer career paths. Such graduates are the new agents for reintegration of knowledge, skills and practices for the 21st century through the new knowledge cultures.

The new knowledge cultures are interdisciplinarity, crossdisciplinarity, transdisciplinarity and nondisciplinarity. These days they are referred to as the knowledge reintegration sciences or team sciences. We thus have interdisciplinary science, crossdisciplinary science, transdisciplinary science and nondisciplinary science. Together they are the liberal knowledge cultures, and when we talk of liberal education or liberal sciences these are the ones. Each of them is a liberal movement committed to liberalizing education and research.

They can coexist in a university setting. Each liberal science now has its own academics at all levels of education producing knowledge and transmitting knowledge beyond the walls of the disciplines. The most liberal movement is that of non-disciplinary science, which does not presuppose existence of disciplines. This is the stance of local knowledge and of the ancient philosophers.

In conclusion, our universities must reorient themselves to face a new challenge of education: that of producing future-ready professionals. They should stop training for the past. Africa must hear this. If it continues to train for the past, then it cannot hope to contribute in any significant way to the human resources of the world.

Africa, more than any other continent, needs a new body politic to advance citizenship, social justice, civic engagement, revitalizing indigenous knowledge and science, and bonding today’s retrogressing cultures to scientific thinking with a liberated collective mind. Future liberation wars should be wars of liberation of the mind. The universities must lead forwards; backwards.

OWEYEGHA-AFUNADUULA: Need For Emancipatory Change in Uganda’s Higher Education

I have before written an article, which did not mince with words, but decried the fact that Uganda’s education is enslaving, not emancipatory. The most enslaving education is found in our institutions of higher learning.
When one enters University, one is lucky if it is not the university that selects for one what courses to study. This act is the begining of introducing the student into an enslaving education.

For the majority of the students, they spend three or more years doing courses that they never wanted to take. When one does not choose what to study one is indeed going to be a slave mindwise or, for that matter, academically fixed and instructed in what one would not choose to study if one were free to do so. One cannot choose one is enslaved.

So, what this means is that for the majority of Ugandan youth they are being prepared to be willing slaves. Indeed, these days when they get out of the university, without any professional leaning they are ready to become anything in society.

They are joining 8n voluminous numbers, the expanding labour reserve, now feeding the modern slave markets of the Middle East. Or else they are doing all sorts of poorly paid jobs. The lucky 9nes have created jobs for themselves often unrelated to what they studied at university.

Structural enslavement of minds is, and has been, pronounced in our universities since the colonialists brought them to us. I am saying universities, but really it was one university the colonialists left for us – The University of East Africa, of which Makerere University College was a constituent College.

Structural enslavement in the College, Makerere University, which succeeded it, and the many universities that have sprang up may be within a School, Faculty, Department or discipline. Where the compartmentalization is strictly adhered to.

It is a fact that interaction of scholars of one faculty, school, department or discipline is limited. This is dangerous in this century when the struggle for critical thinking, genuine interaction, sustainability and future ready professionals who can think freely and independently, is picking up, at least globally.

It is extremely difficult to be a free, independent and critical think when squeezed in a discipline, department, school or faculty in a university. Each school, faculty, department and discipline has its own way of protecting itself from what are taken to be pollutant ideas from else where. When one is squeezed that way one is really enslaved. One will not know that knowledge is one and interconnected, with dimensions that not necessarily exclusive.

Therefore, subdivisions of knowledge into humanities, social science and natural science, or, worse still, into disciplines, are atifial and mind-enslaving. Our brains, can handle far more than we are usually forced to handle narrowly.

The cyberage, which the age of today, is anti-knowledge slavery. It requires all knowledges in an interconnected manner to confront 5ge knowledge disease, which is more deadly than Covid 19.

Yes, if we are going to have critical thinker, who will not be manipulated mindwise and otherwise by adroit actors in our environment, including the academia, we must act quickly to make higher education emancipatory.

Fortunately, we have new cultures of learning that singly and collectively are emancipatory. These are: interdisciplinarity, crossdisciplinarity, transdisciplinary and Non-disciplinarity. Many universities across the globe have opened up to these cultures of learning. In Uganda, at least Mbarara University of Science and Technology has opened up to interdisciplinarity. While we have a plethora of disciplinary scholars, many scholars are now active in the new cultures of teaching and learning.

If one is enslaved mindwise one is absolutely enslaved. If one studies the sociology of our elites, one will find that they all virtually suffer mind enslavement, reflecting their university education. Many find it difficult to engage 8n critical thinking.

Many cannot effectively with others outside their professional orientation. Many are not future-ready professionals. The majority are environmentally-poor and cannot add value to environmental struggles. They are the worst enemy of a safe, clean and secure environment.

Until our higher education begins to experience emancipatory change, we shall continue to produce people better ready to be slaves at whatever level of education than to be future ready professionals.

Nakapiripiriti Elders To Endorse Minister Lokeris Sole Candidate For Checkwi County

NAKAPIRITI: A section of Elders in Chekwi county, Nakapiripirit  district have hatched a plan to make the state minister for minerals Mr.Peter Lokeris Aimat as their sole candidate under NRM come 2026 general elections.

Speaking to this website, Mzee Lorisa Tebakol an elder and a resident of Kadam hill in Nakapiripirit district says Lokeris is still a suitable leader who has has understood on how to help and solve  problems affecting the people of Chekwi.

“We still think Lokeris is still our best leader even though some youth try to come up to contest against Lokeris  we shall advise  them to hold on”-he revealed

Moding Apaloris another elder said Lokeris has never left his people of Nakapiripirit alone adding that whenever there’s  a problem in in the area he’s the first person to reach.

“Recently there was a wave of cattle rustling in Nakapiripirit and Pokot but he stood and United the two pastoralists communities”-he revealed

Who is Peter  Lokeris, born on 2nd February 1947) is a Ugandan politician and accountant. He is the current Minister of State for Minerals in the cabinet of Uganda.

He was appointed to this position on 16 February 2009. In the cabinet reshuffle of 27 May 2011, and that of 1 March 2015, Peter Lokeris retained his cabinet post. He is also the elected Member of parliament representing Chekwii County in Nakapiripirit  district.

He has continuously represented that constituency since 1996.

On Education.

Apaloris said Lokeris has helped hundreds of students of Nakapiripirit and Karamoja  at large to attain education of which some are already members of parliament together with him. He added that, others are veterinary doctors, nurses, teachers, drivers and many others.

This website also learnt that they are about more 40 students whom Lokeris is educating others in mechanical engineering and tailoring John Paul Loduk another elder said the reason they still love Lokeris leadership is good reception.

“When you get stuck in Kampala, and you call Lokeris, he quickly sends the vehicle to pick you up and take care of you at his home for many days and even pays for your transport back to Nakapiripirit but others are so tricky”-he said.

JUST IN: Panic Grips Karamoja As Two UPDF Soldiers, LC3 Chairperson Are Killed By Rustlers

KOTIDO: A Karimojong cattle rustler last night gunned down two UPDF soldiers including one detach commander and LC3 chairperson of Longaroe sub county in Kotido district. The rustlers showered the three people with bullets at Lopuyo trading centre as they had gone for socializing with others at around 9pm.

The names of the two soldiers have not been revealed yet but the LC3 chairperson was called Moses Lomuria popularly  known as Apalobara. Maj Moses Amuya the acting UPDF 3rd division spokesperson confirmed the incident describing it as unfortunate.

Amuya says the rustler  after killing the soldiers and LC3 chairperson  managed to run away with the gun adding that the joint security forces was on the ground tracking him. According to Major Amuya this will not deter the joint forces from pursuing peace in Karamoja.

Mathew Lokut one of the residents in Kotido appealed to government to take  a special action against the Jie community of Kotido.

Meanwhile Major Gen. Don Nabasa the 3rd division commander and his deputy Brig Felix Busizoori have continued to carry out peace dialogue urging the Karimojong to hand over their guns and send children back to school as it’s the only means that will help to develop the region.

Godfrey Kirumira Kalule is a Ugandan businessman who is among the wealthiest people in Uganda with interests in Real estate, Education, Petroleum, hospitality, telecommunications infrastructure development, transportation, private security among others under his GKK group.

Born on the day Uganda got independence in 1962 to the late Zawedde Joyce Nakimbugwe Joyce (Princess) and the Late Muhammad Kirumira, the business tycoon started from humble backgrounds with importing Hankook tires from Korea and bicycles.

Kirumira has since developed his empire and is believed to have a net worth of his fortune to a tune of $400 million with several commercial, residential and hospitality buildings with in and around Uganda’s capital Kampala. The tycoon owns Kirumira towers, Hotel Havana, hotel International. He also owns Royal Complex a bus company, Kirumira Bargary Limited which invests in the Gas and Fuel industry in Uganda.

The tycoon also owns Gelp petroleum a brand which runs seven petrol stations around Kampala. He also plans to venture into upstream petroleum activities with the planned Tilenga Oil fields exploration in the Albertine Graben initially investing a whooping $5 million.

He’s the proprietor of GKO security, a private security firm in Uganda. Kirumira also has partnerships with local telecommunications company Airtel Uganda and MTN Uganda for network infrastructure development in the form of telecom masts.

Talking about this business mogul is a story worth telling, he was once a patron of the local club Express FC for almost a decade with focus on developing talent and to see the club with the local league. He is remembered for recruiting the best players in the league at the time and spending large amounts of money on remuneration to motivate the players and the entire club.

He was once chairman of the Kampala City Traders Association (KACITA) a body that brings together all businessmen and traders with in the city that involves advocacy for better trade and working conditions for all traders and businesses. He’s also the chairman of Kwagalana group which brings together most prominent businessmen and owners of commercial buildings in Kampala. Together with other tycoons, the pool resources to further their investments in real estate, transportation, hospitality among other business interests.

Godfrey Kirumira has investments in education with two institutions of learning which include Bright Future Secondary School Bwebajja, a high school set along the Kampala-Entebbe highway. He also owns St Mary’s Junior School Nabbingo, a primary school which has both day and boarding sections.

The tycoon further owns a mansion worthy UGX2.5m in addition to a string of monster rides including Lexus, Range Rover, Hummer, G-Wagon, Chrysler and many others

Just like his counterpart tycoon Sudhir Rupaleria who is a a Honorary consul of the Republic of Nepal to Uganda, Ambassador Godfrey Kirumira was also recently appointed Honorary Consul of Namibia to Uganda by president of Namibia H.E Hage Gottfried Geingob.

The appointment was formalized during a presentation of credentials ceremony on Thursday, May 6th where the Junior Minister of Foreign affairs Henry Okello Oryem received Kirumira’s credentials.

The minister congratulated Kirumira on his appointment and acknowledged that it would further bolster the relations between Uganda and Namibia.

“Kirumira is capable of doing that job of consolidating and strengthening the relationship between the two countries, promoting person to person contact, promoting trade and opportunities between our two countries and strengthening our political and diplomatic relations”-said Oryem.

Kirumira would later throw a lavish party where at Speke resort Munyonyo where friends gathered to congratulate him on his achievement upon being appointed to such a prestigious position which adds another title to his name of Ambassador.

The A-list guests included the Nabagereka of Buganda, Queen Sylvia Nagginda and indeed her attendance and others surely gave the event a deserved honor. Amidst the honor, feasting, entertainment and dancing, the biggest take way from most people was the seamless transformation of Kirumira into a diplomat.

During the celebration which was graced by legendary Awilo Longomba who took a whooping UGX367m to appear at the event, Kirumira expressed his commitment to strengthening the economic, cultural, and social ties between Namibia and Uganda.

LINDA LILIAN: Gazette and Legalise Public Funded Projects as Public Trusts

The economic tides of time call for critical actions to ensure people are not exploited but become beneficiaries to tangible things they contribute to. Philosopher John Locke would argue that the fruits of a person’s labor is his or her own because they worked for it.

Therefore if a charismatic individual is able to persuade a following to contribute to their agenda, it is only plausible that the contributors become shareholders to what they contributed to. For this to be legal individuals contributing should have evidence of the contribution given to them by their charismatic lead.

Unfortunately most are blindfolded and they do not. And this is where the state ought to come in to enforce regulations that necessitate publicizing and legalizing public funded projects as public trusts.

Today a number of churches are led by gifted leaders whose influence is felt in the number of people they attract. And tithing is a monthly to weekly feat depending on the wages; offertory has become a daily event at every lunch hour and of course there is now the growing declaration of the seed.

But amidst all these, followers are called to contribute for church building projects including buying radios, televisions, land and more; only to have these secured under the leaders names with subtle accountability to the congregants, also contributors.

The records should indicate it’s a public trust therefore a project, by the people and the people; not one individual who managed to get the people to contribute and sometimes added a pinch or nothing to it.

Therefore church land, businesses and projects should be directed, but not solely owned by the individual who held the vision, but not the resources. He or she too ought to be a shareholder in that; and is not eligible to sell anything nor bequeath it to his or her offspring without engaging the stakeholder. It remains an entity, which should generate income and interest for its contributors, for they have a stake in it.

The biblical prescription for the tithe and offerings was to ensure the work of God was effectively done and that included taking care of the congregants. Mathew (23:23) wrote that Jesus abhorred the Pharisees criticizing them for tithing, but neglecting what was important and this was to the people they served. That was justice, mercy and being faithful.

He said they could practice tithing but ensure they also paid attention to these virtues. Remember the Levites too as written by Moses in the book of Numbers (18:26) had to tithe. But they also had tasks to meet while they got their tithe and that was sustaining the work of worship and instructing the congregants in the way of God. Malachi referred to tithing and offerings as deposits in God’s store room.

In Numbers 35 it is pointed out that the Levites were in charge of the cities of refuge where people ran to for justice and protection. While they were there these people were fed and clothed. If a biblical measure was placed on churches today what would be the poll.

In addition to churches, there are communities which are also persuaded to engage in projects, persuaded by Charismatic members. It is still significant that the projects are registered as public trust so that the contributors also benefit since it is a joint effort. Unfortunately today there are schools, hospitals and even factories being singularly enjoyed by cunning individuals who got the whole community to contribute to them.

The practice of allowing free range idealists to captivate the masses and enrich themselves at their expense, requires state intervention to ensure contributors benefit from their input.

JUST IN: Gov’t Declares Tomorrow Wednesday a Public Holiday

The government of the republic of Uganda headed by president Yoweri Kaguta Museveni Tibuhaburwa has declared tomorrow 28th June 2023 as a public holiday.

In an announcement to the public signed by Kaima Godfrey for the permanent Secretary ministry of public service, the day is declared for Muslims to celebrate Eid-Al-Adhuha (Festival of sacrifice).

FULGENCE SSENDAGALA KAJUBI: 2023/2024 Budget Highlights

“Full Monetization of Uganda’s Economy through Commercial Agriculture, Industrialization, Expanding & Broadening Services, Digital Transformation and Market Access’’

Uganda Revenue Authority has been entrusted with this mandate and the actualization of this through revenue collections. This mandate we need to work together to raise and sustain this mandate. URA starts early engagements in each year through its post budget highlights to make citizens aware of what they have to carry ahead and put on the plate and coffers of the treasury.

It is predicted that in the next five years, Uganda will be able to fund its budget and attain its economic sovereignty. Currently the GPD stands at 13.5% and it is forecasted to reach at 14.6% at the end of the financial year 23/24 indicating an increment of 1.1% Averagely on Sub Sahara Africa the GPD stands at 16%. This creates full confidence in government to work together and do business in unusual way to achieve this target.

In this budget of 23/24, no new taxes increases and tax rates have been introduced and this has been so in the last three years. The goal is to increase and expand on the tax base by making sure that all taxable persons be in individuals and non-individuals are put on the tax register, which can be done through massive digital transformation and applicability.

Make out a number of activities across a bigger sector of the society by doing the following;

  • Strong tax regulation programmes.

Make use of the available data to know who pays which tax and on which activities. Due to Implementation of the technologies and tax, digitalization through EFRIS 1.5 Million taxpayers have been identified in the last financial year and this has never existed before. Carry out inter institutional connections or linkages  like NIRA, KCCA, UMEME, NWSC, NSSF, investment authorities Ministry of land and once all give support, you will e able to identify new tax payers who will be put on the tax register and hence Expansion of the tax base.

  • Sensitization.

Creating massive awareness to the taxpayers to understand their rights and obligations based on the canons of taxation is ideal. Let them be aware that their rights are not abused and tempered with by anybody and have a balance overall equation of taxation. Campaigns like “Mpa e-Receipt Yange” must continue in the public and other benefits like winnings, best taxpayer in all categories must be introduced. Strengthening the Tax Agent work to avoid shred and unqualified tax practioners in the field who make mistakes to the taxpayers and later face huge tax liabilities.

  • Technologies.

To improve services and improve customer experience technologies are needed so that paying taxes, filling as well as keeping records becomes, and enjoyment. From 2009, the online filing system has been working effectively, taxpayers no longer go to their area offices for filing, payments are online and real time. There is and introduction of USSD payment code system now using the Kabiriti Phone by dialing *285# where you can pay your taxes by choosing the right tax type, bank, mobile money extra. Contact person is working 24 hours, there a Wasp line to channel your queries, TINS can be accessed online by putting your NIN, Passport number, Permit, the date of birth the rest is populated, and a TIN is generated in a minute. The technology is to improve on accuracy of assessments, monitor every sale, payment and purchases on local market or imports. This allows the refunds in VAT and WHT fast. EFRIS platforms like system-to-system, EFSTs, Web application USSD, and DTS (digital tracking systems) are in place

These can be done by implementing the following;

  • To accelerate by dividing resources, jobs, wealth maximization.
  • Effective implementation of the Parish Development Model
  • Upgrading infrastructure example the standard gauge railway and roads. 6Milliosn USD has been appropriated to renovate and remodel all roads in Metropolitan Kampala in the current budget.
  • Promote the use of Small Solar
  • Build infrastructure of industrial parks. We have a lot of them including Mukono, Namanve, Kapeka have already attracted a good number of Investors
  • Invest in oil and gas and start production
  • Continue to support the public private partnership to access credit example Agriculture credit fund, Small and Medium business recovery fund ( SMBRF) , Emyoga Parish Development Model, Uganda Development Bank for medium and large companies etc.
  • Invest in tourism to market Uganda
  • Continue investments in peace and security

WHAT DOES URA INTEND TO DO?

  • More use of technology 3- Invest in Bonded ware house information systems
  • Create and strengthen better relationships with taxpayers.
  • Limit and eliminate Agency Notice Issuances as its not goods to taxpayers.
  • Emphasize compliant
  • Invest in e commerce -EFRIS
  • Sensitize taxpayers to file right returns and pay right taxes.
  • Over 60 staffs have been allocated to carry out ledger reconciliation. This has been a challenge due to application of different laws
  • Ensure expedite the issuance of Tax credit certificates (TCC)
  • WHT exemptions
  • ADR guidelines and fast tracking and solving of cases.
  • Voluntarily payment of taxes through the voluntarily schemes.
  • Embark of Sharing about financial flows abroad and overseas through the Convention on Mutual Administrative Assistance in Tax Matters (the Convention) is a freestanding multilateral agreement designed to promote international co-operation for a better operation of national tax laws, while respecting the fundamental rights of taxpayers and Article 25 which  establishes a “mutual agreement procedure” (MAP) that  enables the parties to a bilateral treaty to better carry out the interpretation and application of the substantive treaty provisions.
  • In addition URA to redefine its pillars in terms of Values, Integrity and Professionalism which will reduce corruption to zero.

Budget Commentary

The budget for the FY 2023/24 is aimed at achieving the following broad objectives:

  • Completion of key public investments with higher multiplier effects;
  • Enhanced revenue mobilization;
  • Full-scale operationalization of the Parish Development Model (PDM); and
  • Enhanced government efficiency and effectiveness through rationalization of public expenditure, payroll audit, etc.

The revenue collection target for the fiscal year ending June 2024 represents 14 percentage of GDP. The Public Debt is projected at Ugx 88.9trillion by30th June 2023. This is about 48.2percentage of GDP a drop from 48.6 percentage in FY June2022. About Ugx.16.2Tn is allocated to public debt related obligations

UNDERSTANDING THE KEY TAX AMENDMENTS FOR 2023/2024

There are roughly seven Tax Amendment Bills 2023 as below

  1. The Income Tax (Amendment Bill 2023)
  2. The VAT (Amendment Bill 2023)
  • The Excise Duty ( Amendment Bill 2023)
  1. The Tax Procedure code ( Amendment Bill 2023)
  2. The Lotteries and Gaming ( Amendment Bill 2023)
  3. The Traffic and Safety ( Amendment bill 2023)
  • The Convention and Mutual Administrative Assistance in Tax Matters ( Implementation Bill 2023

Below are the Amendments in each bill

Income Tax

  • Unit trusts.

In the new amendments, the definition of a company has been changed to exclude Unit trusts from the definition of a company.

Section 2(n) states that a company means a body of persons corporate or unincorporated whether created or recognized under the law inforce in Uganda or elsewhere and a unit trust but does not include any other trust or partnership. If trusts are removed from the definition of a company, it implies that these units should not be treated as companies and more so on how to treat the returns to the participants as dividends. The justification for the exclusion is that all unit trusts are registered as companies

Removal of Initial Allowance

The bill has removed initial allowances of 50% of the cost of items of eligible property placed into services for the first time outside a radius of 50 KM from Kampala as well as an initial allowance of 20% of the cost of a new building for the first year the building is placed in services. Therefore, Section 27A has been repealed; in effect, taxpayers will not be entitled to this capital deduction. The rationale is to increase revenue for the government.

Interest deductibility under section 25 of the Income tax act.

Section 25(3) has been amended to include Micro Finance Deposit taking and Tier-4 Micro finance Institutions.  There has been exclusion of the interest capping on debts owed by the micro finance and Tier 4. The objective is to level the ground for all deposit taking financial institutions and allow access to finance by Micro, Small and Medium Entropies.

Exempt income of prosecutors

Section 21 has been amended to include employment income in the prosecutor in the office of the Director of Public Prosecutions.

Introduction of 10% WHT on commissions to agent bankers

There has been an introduction of 10% WHT on commissions to agents’ bankers to match with other agents and level the ground.

Value Added Tax

Auctioned goods

Auctioning goods by an auctioneer to be a supply of goods made by the auctioneer. Auctioneer will have an obligation to charge VAT and comply accordingly.  Act has been amended by treating the disposal of goods at auction as a supply of goods made by the auctioneer. The Act further provides that the treatment of the supply of goods by the auctioneer under subsection (3) is separate from the treatment of the supply of the auction services by the auctioneer.

Where the auctioneer deals in goods and or services that attract value added tax, that auctioneer will be required to register for value added tax provided the sales meet the turnover threshold.

The auctioneer will also be required to charge VAT on the auctioned goods, and auction services, remit it to URA and file monthly value added tax. This will enhance the revenue collections

Broadening the definition of Electronic and related services

The Amendment expands the rules for electronic services supplied in Uganda to cover persons outside Uganda who do not have a place of business in Uganda but supply to recipients in Uganda. .Such suppliers under the new provisions may file a VAT Return and pay the VAT in United States Dollars. A supplier from a place of business outside Uganda to a recipient in Uganda including has amended the Act to expand the definition of electronic services to mean services supplied through an online or digital network;

  1. websites, web-hosting or remote maintenance of programs and equipment;
  2. Software and the updating of software;

iii. Images, text, and information;

  1. Access to databases;
  2. music, films, and games; including games of chance;
  3. Political, cultural, artistic, sporting, scientific and other broadcasts, and events; including television;

vii. Advertising platforms;

viii. Streaming platforms and subscription-based services;

  1. cab-hailing services;
  2. cloud storage;
  3. Data ware housing; and

xii. Any other service as the Minister may by statutory instrument determine.

The definition of electronic services has been widened to include advertising platforms; streaming platforms and subscription-based services; cab-hailing services; cloud storage; and data ware housing.

Expansion of the scope of supplies considered to be made in Uganda.

This will include a person carrying on a business in Uganda if the recipient of the supply is not a taxable person or a person who makes a supply with a total annual value in excess of UGX 150 Million or a Government entity that is not registered.

The amendment is that the Persons providing those services will be required to register and account for VAT in Uganda, if the sales from these services meet the turnover threshold. The essence is to widen the Tax base and collect more revenues for the Government.

Cancellation of exemption and amendments to the Second Schedule (VAT Exmept Supplies)

  • Supplies added to the exemption list
  • Animal feeds, premises, concentrates and seed cake.
  • Billets for further value additions in Uganda
  • Supply of liquefied and denatured fuel ethanol
  • Supplies to be removed from the exemption list.
  • Cotton seed cake
  • All production inputs into iron ore smelting into billets

The supply of all production inputs necessary for processing of hides and skins into finished leather products in Uganda and the supply of leather products wholly made in Uganda; The above supplies will not be exempted from VAT and as such suppliers of those items will be required to register and account for VAT on them if they meet the turnover threshold.

Restriction on the Credit for Input Tax and

There has been Expansion the list of taxable supplies for which VAT input credit cannot be utilized to include

  • payment for entertainment made by a taxable person for membership of a person in a club, association, or society of a sporting, social or recreational nature ; or
  • Payments made by a nontaxable person outside Uganda making as supply of services to a nontaxable person in Uganda such as nonresident suppliers of electronic services
  • The Act has also been amended to limit the input credit claimable to that incurred for “business use” or “use in the business” purposes to apply only to the related business, generating a taxable supply.

Provision to file VAT returns and pay tax in United States

  • The Act has been amended to allow a non- resident taxpayer to file VAT returns and pay the resultant tax in United States Dollars.
  • This applies to non-resident persons who supply services to persons who are not registered for VAT in Uganda or where the non-resident’s sales exceed the turnover threshold
  • This implies that a non-resident who supplies services to a person in Uganda not registered for tax or where the non-resident’s sales exceed the turnover threshold will be allowed to account for the VAT in United States Dollars.

Others include.

  • To remove the waiver on interest payable as at 30th June 2027, where the interest exceeds the aggregate of principal
  • To add to the First Schedule of the Vat act Public International organizations EP-RE (PTA Reinsurance Company) these organizations are entitled o certain VAT relief like claiming VAT refunds and services becomes cheaper.

Tax Procedures Code Act

  • Requirement of a Tin to register and an instrument required to pay stamp duty under the stump duty Act 2014. No local Authority, Government institution or regulatory body shall be register for an instrument to pay stamp duty unless the person lodging the instrument has a TIN
  • Waiver of interest and penalty where the taxpayer pays in whole or in part of the principal tax outstanding at 30th June 2023, by 31st December, 2023. Where part of the principal tax is paid, the amount of interest and penalty waived will be on a pro –rata basis.
  • Limitation on the presentation of new information at objections stage or under the Alternative Dispute resolution. Proceedings. Where a taxpayer fails to provide the information requested, that taxpayer should not be allowed to provide that information at objection to a tax decision or during alternative dispute resolution procedure proceedings. This restriction will not apply where the information requested for is more than 3 years from the date the document was authored or beyond the past 3 financial years.
  • Clarification on payment allocation where the taxpayer makes a payment that is less than the total amount of the tax, penal and interest. The amount paid in part will be applied to the principal tax first.
  • Parliament to approve remittance of tax. It will help on decisions that affect the consolidated fund.
  • Introduction of new offences relating to Digital tax stamps and impose high penalties and sentences upon conviction to offences committed. This will enhance compliance

Lotteries and Gaming Bill: Amendment Bill, 2023

Exclusion of winnings derived from gaming from Withholding tax. This implies that a 15% will not apply of payment of winnings from gaming. This will address the compliance challenges and collection has been a problem as taxpayer continue gambling as they win the games. The bill will increase the gaming tax rate from 20% to 305 of the total amount of money staked less the payouts or winnings for the period of filing returns for the gaming activity

Convention on MAA in Tax Matters (implementation Bill), 2023

The Bill domesticates and gives the force of law in Uganda to the Convention on Mutual Administrative Assistance in Tax Matters; and the Multilateral Competent Authority Agreement on Automatic Exchange of Financial Account Information; and the Standard for Automatic Exchange of Financial Account Information in Tax Matters.

The Traffic and Road Safety (Amendment) Bill, 2023

  • Introduction of acceptable speed limit and provision of a fine upon conviction.
  • Requirement of a professional driving permit (not a badge of recognition for drivers of persons who wish to provide an online digital platforms for the provision of public service transport to passengers or goods

Customs Amendment for the financial year 2023/2024

The HS code and items are listed in the Amendment Bill.

Excise duty (Amendment) Bill, 2023

  • Introduction of the definition of Fruit Juice.
  • Introduction of the definition of un denatured spirits
  • Introduce the definition of Vegetable Juice
  • Amendment of the second schedule of the Excise Duty act.
