1. The Death glare:

Hello, perhaps you are asking for it. Are you having an awful way of saying wrong things always? For instance, lazy employee’s slogan, “ That isn’t my job”, “ That’s not the way we used to do it at my former job”. such words are annoying, that is a destructive behavior which is commonly found in majority of employees and such a person cannot work with a demented boss for a long time.

2.The boss investigates on you:

Your manager will regularly ask your workmates about your daily attendance and job performance, while other colleagues in your department are not always investigated. Possibly the causes involve lack of trust, controlling or managing every department, or even psychopathic case . Nevertheless, the best solution is to approach your boss honestly and ask him / her to work together better.

3.Jealousy:

Perhaps you could be knowing more about your manager’s job better than he / she does, or you have a better looking, always dress smarter, may be you fell in love with someone whom he / she admires and etc. Some inexperienced managers normally lack self-respect and confidence and may try to reimburse for these uncertainties by oftenly downgrading junior’ performance.

4. Your salary raises request denied:

Your boss might tell you that “ no salary increment for you”, it does not necessarily mean that your job reeks, may be it’s the budget restriction, but a good boss that values your efforts will humbly explain why you will not get a salary raise soon and will estimate when he thinks you will. However the bad manager will keep ignoring your salary raise requests, will keep promising to settle everything soon and you cant guarantee when exactly.

5. Few responsibilities:

Responsibilities that you used to manage are now being assigned to your workmates. New ones are being given to others. To make it worse, you’re being ordered to train new employees to do your job. Oh my God What’s happening? May be the management is in the process of firing you.

6. No promotions given:

You have done the same job for many years, you’ve shown your capabilities, you have proved to them that you’re responsible, smart and reliable person. But unfortunately, when new opportunities come, you’re avoided. Oh my God what’s happening? Of course your boss hates you. Or may be he / she knows how beneficial you’re in your present job especially if you’re good at it. It’s good for the boss, but not good for your profession.

7. You get the terrible jobs always:

You’re regularly assigned low-status jobs?, making coffee, cleaning the toilet, cleaning the office, making photocopies after working hours and collecting mails. When you’re told to do all the above that simply means the boss has a low attitude of your skills or he / she thinks you have nothing better to do.

8. Mean comments:

You’re always under-looked by the boss. Of course, these poisonous insult and smirk, especially if targeted at everybody within a distance, can be a sign of a terrible manager. But if you’re the endless target of this type of verbal deliberate cruelty, you better do something to stop it, alternatively, ask the boss to stop, just quit, seek the help from HR ( if this is not allowed ) or persevere silently.

9. Being ignored:

You must have realized that in most cases your boss has no time for you! Always forgotten,meetings are always cancelled, changed / postponed at the last-minute, or perhaps you don’t get any response at all. Ever since the Anti-Homosexuality bill 2023 now the Anti- Homosexuality Act was re-introduced to parliament in March this year, some of the religious leaders who have been vocal in supporting it was the Arch Bishop of the Church of Uganda Dr Steven Kazimba Mugalu.

Not only him many religious leaders and other Ugandans urged the president to sign this bill into law. These say that homosexuality is something for uncultured people and it’s not african but something that’s just being imposed on Africans and Ugandans.

Prior to passing of this bill, the Church of Uganda together with the Global South Fellowship of Anglican Churches while in Rwanda resolved in union that they will consider cutting their ties from the Anglican Church in England after the Arch Bishop Justin Welby ordered Anglican Churches to wed homosexual couples.

The Church of Uganda even threatened to stand on it’s own than supporting that irregularity which is not even any where in the teachings of the bible.

In the statement released by Bishop By Arch Bishop Justin Welby, just like other western powers urges the Church of Uganda and Arch Bishop Kazimba Mugalu to change his stance on supporting the Anti-Homosexuality Act 2023 and instead call for it’s repeal or agitate for stopping of it’s implementation.

“I have recently written to my brother in Christ, the Primate of Uganda, Archbishop Steven Kaziimba, to express my grief and dismay at the Church of Uganda’s support for the Anti-Homosexuality Act. I make this public statement with sorrow, and with continuing prayers for reconciliation between our churches and across the Anglican Communion….”reads part of the statement from Canterbury

Welby says he’s greatly disappointed by the Church of Uganda’s stance in supporting the Anti-Homosexuality Act. He says the Anglican Church in it’s resolution i.10 of the 1998 Lambeth Conference holds the value of sexuality and marriage and blesses them regardless of the sexual orientation of the couples.

“The Church Of Uganda, like many Anglican provinces, holds to the traditional Christain teaching on sexuality and marriage set out in Resolution i.10 of the 1998 Lambeth Conference. That resolution also expressed a commitment to minister pastorally and sensitively to all- regardless of sexual orientation- and to condemn homophobia. I have said to Arch Bishop Kazimba that I am unable to see how the Church of Uganda’s support for the Anti-Homosexuality Act is consistent with it’s many statements in support of Resolution i.10”- reads part of the statement.

The Anti Homosexuality Act has received support locally but condemned globally especially in the west where they call homosexuality a human right. The west have also threatened to withdraw support they render to Uganda because of the Anti-Gay Law.

Not only Welby, the Archbishop of York Steven Cortrell also has condemned the Church of Uganda’s support for the Anti-homosexuality act which they say is homophobic and discriminative in the way it criminalizes those involved in same sex and queer behaviors.

Mount Kenya University Boss Gicharu Caught In a Land Grabbing Saga As Over 5000 Squatters Face Eviction

A large group of squatters in Naivasha, Kenya, has issued a strong warning, declaring their intention to march to the Mount Kenya University campus in Nakuru next week on Monday.

They accuse the university’s chairman, Dr Simon Gicharu, of unlawfully seizing their vast land parcel spanning  to 16,000 acres and forcibly evicting them with the assistance of the local administration.

According to local residents who shared their grievances, they have inhabited the area for several decades. In 2019, the government established a local school for approximately 3,000 squatters and made promises to subdivide a portion of the land to accommodate their needs, as they had nowhere else to go.

The situation escalated further last week when witnesses reported the arrival of Mr. Gicharu by helicopter. Allegedly, he conducted an inspection of the ongoing evictions and the subsequent destruction of crops, which resulted in the burning of houses.

James Ndungu, a local farmer and a victim 54 year old expressed the dire predicament they face, stating, “We have nowhere to go. Simon Gicharu, the owner of Mount Kenya University, claims to have purchased this land from the government and now wants us out.

He accused Simon Gicharu of utilizing the police force to obstruct justice, and we believe the media has been compromised. They come to interview us, but later receive payments from Gicharu and fail to air our grievances.

The affected squatters, as a result, staged a camp-out at the office of Nakuru Governor Susan Kihika and the Regional Commissioner in an attempt to secure an audience and address their concerns.

‘’We have nowhere to go, Simon Gicharu who owns Mount Kenya university claims he bought this land from the government and now wants us out. He is using the police to defeat justice, the media has been compromised, they come to interview us and later get money from Gicharu and never air our grievances,’’ James Ndung’u 54 told the writer.

Isabella Namazzi, a squatter, expressed their distress and disillusionment, stating, “We have been left vulnerable and hopeless. It appears that the police, media, and local administration have been enticed.

According to the majority of farmers residing in the affected area, known as Ndabibi and Kosovo, they assert that it is their rightful home.

They have accused  Mr. Gicharu, the chairman of Mount Kenya University, and another influential individual named Benjamin Kipkulei, are both laying claim to ownership of the land.

‘’We have been left vulnerable and hopeless and because police, media and local administration has been bribed not to share our grievances we will on Monday protest outside Mount Kenya University Nakuru campus so that the people who think that Simon Gicharu is a role model and an educationist can now know that he is land grabber,’’ Isabella Namazzi from Uganda and who is a squatter told this publication.

Simon Gicharu is well known in Kenya, Rwanda and Uganda where he has widespread campuses of his university.

In Uganda, his university, Mount Kenya University has a partnership with Makerere University.

At one time, Rwanda stopped his university from offering medical courses saying the quality offered was substandard. Reports indicate that Mr Gicharu want to set up a flower farm in the contested land targeting the lucrative export market.

Last year during general election, Gicharu is said to have bankrolled Raila Odinga campaign and also giving his institution in Thika to be a strategic Azimio centre.

Simon Gicharu is said to have given Raila Odinga a personal contribution of Ksh.240 million.

“It was a well-attended event. Most contributors never wanted to be identified but what I know is that S.K Macharia gave a personal contribution of Ksh. 30O million and Mr. Gicharu through a proxy sent 240 million towards funding Odinga’s campaigns,” a source who attended the dinner where a buffet per individual was retailing between Ksh 500,000 to 1 million told this publication.

Barcelona Find It ‘Very Difficult’ To Sign Bernardo Silva

Barcelona have been rocked by Lionel Messi’s decision to join Inter Miami in the coming summer. However, Messi’s rejection could pave the way for the club to explore other options in the market.

According to SPORT, one of the targets Barcelona are pursuing is Bernardo Silva. The Portuguese international is apparently keen on leaving Etihad at the end of the season and would be interested in a move to Spain.

Silva, whose market value stands at €80 million, has been on Barcelona’s radar for a long time. He was notably linked with a move to Camp Nou last summer, but the move did not materialise as Barcelona did not have the financial strength to pull off the deal.

However, the report points out Barcelona are likely to suffer from a similar issue this time out. The club do not have the economic strength to pursue Silva and must offload a bunch of players if they are to secure a deal for the Portuguese international.

To make things worse, PSG are interested in the services of Silva. The French giants are ready to make a move for the Man City superstar ahead of the new season, as part of the club’s plans to rejig their attacking unit following the exit of Lionel Messi.

Barcelona are not in a position to compete with PSG for Silva. They cannot match PSG’s economic offer for the Portuguese international, both in terms of transfer fee and the player’s contract. Hence, the Blaugrana see the attacking midfielder’s signing as ‘very difficult’.

Silva, for his part, wanted to move to Spain, but he has made peace with the fact that PSG could be his next destination, as he moves closer to exiting the Etihad this summer.

Barcelona, therefore, must shift their attention to other alternatives in the market as they look to beef up their options in the creative department.

FULGENCE SSENDAGALA KAJUBI: Proactive Tax Risk Management & Tax Compliance Status Checklist

This article aims at illustrating to the taxpayers the most pressuring issues that increase URA’s scepticism and triggering an Audit and how to proactively plan the tax risks in the organizations.

Over time tax, administration has been done through self-policing where taxpayers raise their own self-assessments and declarations to the Tax Authorities in regards to the taxes to be filed and paid.

However, this does not mean that the tax authority will never go through your records to test their completeness, accuracy, proper classifications, and proper declarations, non-misrepresentation of facts or misinterpretations of the laws applied in each tax filed.

Therefore, this mandates them to review your records and let you be aware of the inconsistencies if any and get advised to amend and show a true picture of your tax affairs. Where you fail to respond, the Tax authority has no option but to raise an administrative assessment and or additional assessment such that they correct the wrong position you filed and this usually comes with a tax liability to pay.

Article 26 of the Tax procedures codes states that the onus is on the taxpayer to prove that the tax so assessed is in excess.

General compliance issues.

  1. Have you kept proper books of accounts?
  2. Did you file your return on time or requested for extension of time to file the return?
  • Do you make proper and accurate provisions?

The above three issues if not addressed well can result into a URA estimated assessment that can be onerous and any attempt to object  and appeal to it would require you to have proper support documentation and a technical person like a tax agent, a law firm or  Audit firm to solve it with URA team.

Therefore, to avoid these embarrassing moments in your business, you are advised to be proactive in tax risk management strategies by doing the following;-

Carry out a self-Tax health review.

By law in Uganda, the taxpayer is supposed to at-least keep the records for five years; likewise, the Tax authority is mandated to audit the taxpayers for at least five years on the road. Except in rare case where need may arise and they can go beyond this period. Therefore, as a taxpayer, you must develop a habit of carrying out your self-tax health checks or reviews in some of the following areas;

  • Employment costs

Compare that your employment costs claimed in the income tax returns over the year matches with each of the PAYE return filed in that fiscal year. The only variances expected may be in terms of the provisions made for leave, gratuity, bonuses or any other lump sum payments. Such increases or decreases in provisions must be reflected exactly in the Add back position of the tax computation. Where causal wages are paid to casual employees, please file their PAYE & NSSF or automatically disallow this expense.

Please note also that where such casuals are subcontracted and managed by the subcontract, keep records of contracts and other engagement records.

  • Issuance of credit note.

These credit notes must be correlated with the beneficiary’s declarations in the returns. Do not pass credit notes in your ERP and fail to pass them in EFRIS and file them in the VAT returns

  • The input credit

The input credit claimed on import purchase must match with Asycuda reports of URA or customs data and any variance must be justified.

  • Retained earnings

The retained earnings brought forward from the previous year’s being declared in the current years declarations must match with the retained earnings carried forward in the balance sheet. Many taxpayers have faced a wrath in terms of assessments because they do not file well this area.

  • Deferment VAT

Under the deferment Act, a taxpayer is allowed to defer VAT on importation of Plant & Machinery. Note that usually the customs will show that you enjoyed VAT deferment on purchase of plant and machinery but did not account for its VAT in accordance with the deferment Regulation of 2013. Therefore, make sure that the machines are installed in the production of goods and can easily be verified in case they come for a visit. This VAT is only paid as per Article 7 of the Deferment Act that is upon sale or disposal of such machines.

  • Mismatch in VAT paid at importation against VAT claimed in monthly return

The VAT paid at importation must match with the VAT declared in the Schedule 3 of the VAT return. If there is any variation, it must be brought to book and explained to URA. This may be as a result of some entries failing to fiscalize on time in that specific month or year. Make sure that after payment for the entries, an exit is done on time in Asycuda and where a challenge is faced; communicate through raising a ticket to EFRIS or customs team.

  • Variances in sales Turnovers

Here most taxpayers do not bother to match their VAT returns with the Audited sales numbers in the Audited books of Accounts. Even some Auditors do not bother to reconcile these numbers. It is an automatic area that triggers scepticism for Audit by URA yet you could have done it yourself.

Whenever the Audit is done please ask for the reconciliation of VAT return and Sales in The Audited Books of Accounts. Discounts, cancellation or reversals of sales in the system may lead to such imbalances if not booked in VAT returns. Today, the VAT return, the ERP sales and the EFRIS sales under the Z table report and detailed report must all match .This applies to purchases too.

  • Undeclared Imported services VAT & WHT

Does your company import services from other countries?  If yes, please master the art of accounting for such a transaction. First, it will attract the 15% Withholding Tax and 18% VAT. Where you only withhold the 15% and fail to account for the 18% VAT as a consumer of such a service, then the tax liability and exposure will be manifested and you will pay with penalties. So plan well this area.

  • Variances in Asycuda Exports Versus VAT

Exports are zero rated products, meaning that had they not been exported and locally sold, you must account for their VAT. Therefore let your clearing agents do the right declarations and reconcile every month your exported goods against your invoiced sales.

This will eliminate the challenges of variance between the customs data and your declarations. Use the exchange rate as shown on URA portal every month to eliminate the forex fluctuations. If there is any failure to match the exports with customs data, it be will assumed, as dumping and thus penalties and payment of 18% on the variances will be imposed to the taxpayers.

  • Overstated related party loans/transactions

In a multinational setting, enterprises are much related and those with financial muscles or the parent may extend a facility to the starving companies. Where URA discovers that the related party loans are over stated in the balance sheet and have no support or agreement, the audit team from UAR will reclassify them and charge you 30%, as they will be assumed as income. Please keep proper records and Transfer pricing in place to avoid such cases.

  • Costs of sales

Maintain production schedules if you are a manufacturing company, keep your records of purchases and stock movements or issues of materials. Understand your mark-up on the costs. Keep the records of coefficient for the input and output ratio .Cost of sales is a key component in our books of accounts as it reflects the costs of our purchases that we have sold.

Do you know the cost plus/mark up or margins that you add or earn on our costs for the purchases? Which other costs do you include in this line item? If you do creative accounting at this level, the re-computation by a taxman will definitely catch you. It is advisable you do the right thing first time.

Rent Expenses.

In many cases taxpayers claim this expense but without showing the TIN of the property owner. Automatically the system prompts to put that TIN. However, some taxpayers fail to get the TIN of their property owners and instead absorb this expense elsewhere.

Just ask yourself how do you run a business, which does not own a building and has not paid any rent in the year of income? If it is an online business then the payments for the market space must be expressly shown in the returns. Failure to do so, will lead to suspicion by the taxman and hence an assessment.

Supply of assorted materials to your clients

Please keep the following in place

  • Keep the certified copies of the contract between your company and the contractor.
  • Certified copies of invoices and payments vouchers reflecting the mode of payments
  • Any other relevant information.

Accounting of deemed vat

As provided for in the VAT return, detailing the description of each supply. Please keep a proper record of all the supplies. These may include

  • Purchase orders
  • preform invoice
  • delivery notes
  • the fiscalized documents number –Invoices
  • customer statements
  • Proof of payment by your customers.
  • Among other

VAT refund

Any tax payer is free to exercise his or her right under section 42(1) of the Vat Act to apply for the excess credit of vat paid in excess of UGX 5,000,000/=. The Tax authority has the right to reject your offset after advising you to claim for the credit and you do not adhere.

There is much need to plan for the VAT position through the purchase of Imports and local purchases against the sales made. For those in manufacturing, and have bonds, it’s advisable that you pay taxes and remove materials from the bond, produce materials and at end month makes sure that the sales for the produced materials is made.

Otherwise, where you pay taxes and produce but do not sell the produced goods, it will make you be in claimable position and thus triggering and Audit from URA.

Payment of taxes on wrong tax heads

Make sure that you do not pay your taxes on wrong tax type. Choose these tax types carefully. For example if you are paying for withholding tax for Income tax purposes, do not generate the Payment registration number (PRN) for VAT Withholding payable. This will cause your ledger not to balance, as one credit will be placed where it is not supposed to be hence causing an imbalance on the ledger and assessment.

Directors returns.

Ensure that all your directors’ returns are filed on time and the portal is updated always. Where some directors are on payroll be aware such that when the tax authority queries, you are able to answer that on time.

Tax clearance certificates.

The advantages of the TCC is that it secures you businesses. Most suppliers ask for it in bidding or other occasions. Most taxpayers think that when they have the TCC, they do not have any tax obligations to pay.

It is just a clear tax indicator that your tax affairs are fine. Therefore, always pay your taxes on time. Check and reconcile your tax ledgers such that there is no liability that will lead to denial of the TCC. On the other hand, apply for the TCC on time to avoid a delay in approving it.

Filing taxes on time

For all the tax heads, there are differently stipulated deadlines, which must be adhered to. For example, all the monthly returns like VAT, PAYE, Withholding Tax for VAT and Income must be filed by the 15th day of the following month. Other taxes like provisions, Final income tax returns must also be filed as per their due date.

Failure to do so on time it attracts penalties and interest, which will keep on accumulating on your ledgers. I have seen taxpayers being assessed penalties above 20M due to failure to comply by filing their returns on time.

Conclusion

Let us be vigilant with taxes in all our spheres, appreciate that taxes help our governments to build the nation by putting schools, hospitals, roads etc. By understanding the above points, everyone will be able to enjoy why taxes are very important and hence pay the taxes as and when they follow due.

In addition to the underlined points, it is imperative to note that all taxpayers should mind about completeness, accuracy, proper classification and proper declarations in their returns and records. This will save us 100% chances of being suspected for declaring misleading information and being assessed huge taxes. Remember, the onus is on the taxpayer to prove that the tax so assessed is high or not.

Residents Want Water Umbrella Organization Out Of Bukwo, See Why

BUKWO: A section of concerned residents of Bukwo town council in Bukwo district have demanded for immediate exit of Water Umbrella organization one of the ministry of water and environment departments managing piped water system in Bukwo district.

This follows after the department failed to protect a water reserve tank when unknown persons went and contaminated the tank with a chemicals.

On Wednesday, a yet identified person accessed the tank that supplies piped water to the whole town council, opened it up and washed the spray gun with chemicals inside the tank.

The team from the water Umbrella Mbale rushed to close the tank from distributing water but the community had already consumed water for the whole day.

Joel Mongusho a resident urged the government to deploy another service provider like National water and Sewerage cooperation to take charge of water system in Bukwo.

“This is a sign that this department under the ministry of water and environment does not have the capacity to protect the lives of people imagine how can a stranger gain access to the tank which is supposed to be out of bounds for anyone and watch a spraying gun inside the clean tank”-Mangusho questions.

Rose Chemutai another resident says she’s feeling so weak ever since she took the water.

“I want to go to Kapachorwa for general check up because am afraid of the contaminated water that I took”-Chemutai say

Deneth  Ngabirano the manager of Water Umbrella confirmed the water was contaminated by someone who he claims they have arrested and handed over to police.

Ngabirano who first attacked the media claiming they are only interested in negative reporting about the ministry of water later said they have closed the system and poured all the water from the tank.

“We are waiting for the chlorine to wash the tank”-he revealed.
