In recent years, Kenya has made notable progress in environmental conservation, exemplified by initiatives such as the ban on plastic bags, which reflects our dedication to a cleaner, more sustainable future.

However, amidst these commendable efforts, a glaring inconsistency persists: the National Environment Management Authority (NEMA) fails to effectively enforce its own regulations.

The 2017 plastic bag ban was hailed as a significant step in tackling solid waste issues in our nation. As a concerned miller, I am deeply troubled by NEMA’s lack of action in addressing violations of the plastic bag policy.

Despite the ban, some millers blatantly flout the law, posing risks to our ecosystem and public health. What’s even more troubling is the apparent involvement of certain NEMA officials in overlooking these violations for personal gain.

Reports of corruption within NEMA cast doubt on the agency’s commitment to its mandate of protecting our environment.

Despite NEMA’s warnings issued in November 2023 to manufacturers and importers regarding the illegal use of plastic bags, non-compliance persists. It is imperative for NEMA to break this cycle of negligence and hypocrisy. Mere warnings are insufficient; concrete actions are necessary to hold violators accountable. The law is clear, and those who violate it must face consequences.

The repercussions of NEMA’s inaction are severe and widespread. While we strive for sustainability, our competitors exploit loopholes in regulations, flooding the market with cheap, plastic-packaged products.

Furthermore, there is a stark pricing disparity between products packaged in plastic and those complying with the ban.

Despite the higher costs of non-plastic packaging, some millers cling to plastic bags solely for increased profit margins.

Meanwhile, those of us committed to sustainable practices find ourselves marginalized, struggling to compete in a market where price often outweighs principles.

It is an injustice that while honest millers suffer, lawbreakers thrive with impunity.

Reports of substandard products flooding the market go unaddressed, as NEMA turns a blind eye to those abiding by the rules. This imbalance undermines fairness and justice, favoring the unscrupulous few.

Even supermarkets, expected to uphold corporate responsibility, are complicit by ignoring the origins of the products they sell.

Despite NEMA’s warnings, millers persist in using plastic bags, emboldened by the lack of enforcement.

It’s time for NEMA to enforce the law impartially, ensuring that those responsible for environmental harm face consequences. The livelihoods of honest businesses, the well-being of our communities, and the integrity of our environmental laws are at stake.

The plastic bag ban was not just a policy; it was a promise for a cleaner future.

NEMA, entrusted with safeguarding our environment, must fulfill its duty. It’s disheartening to see the agency neglecting its responsibilities, especially regarding such a crucial issue as the plastic bag ban.

The time for NEMA to end this cycle of negligence and hypocrisy is now. Honest, law-abiding millers are counting on it.

NEMA must rigorously enforce the plastic bag ban, hold violators accountable, and ensure supermarkets refrain from stocking non-compliant products.

The law is clear, and it’s time for everyone to abide by it. NEMA, the time for action is now.

The premier league is now in it’s sweet moments as it nears the end. We’re now firmly into serious business of the 2023-24 season and the battle lines are already drawn on who will be crowned Champions of this season.

It’s however clear that this year’s Champion will either come from North London, Mercy side or from Manchester. Arsenal, Liverpool and Manchester City are the favorites going by how the table is currently standing.

CHAMPION’S LEAGUE CLASH: “They are Bayern, But We Are Arsenal”-says Jesus

Arsenal will be taking on Bundesliga struggling Champions Bayern Munich at 10:30pm EAT, it’s Arsenal’s first time to reach Champions League Quarter finals since 2010. On March 19th, Arsenal was pitted against Barcelona.

Years that followed, Arsenal under Arsene Wenger would later struggle against several teams but Bayern Munich thumped Arsenal severally whenever they met in Champions league.

Tonight’s game will be Arsenal’s tie with Bayern since 2017 when they lost to the German giants on 1-5 on March 7th 2017 at the round of 16. But Arsenal had still previously lost 1-5 to Bayern at home on Wednesday Feb 15th 2017.

Now ahead of tonight’s clash with the German giants, an Improved Arsenal which is even competing for the Premier League for the 2nd consecutive year against a struggling Bayern is a game to watch. Given that we’ve reached the quarter-finals of the competition, there is no reason to be intimidated by the opposition, he pointed out in his press conference yesterday.

“If we arrive in the quarter-finals of the Champions League it’s because we deserve it and we have quality,” he said. “We have to respect Bayern. They are Bayern, but we are Arsenal. They respect us as well so it will be a big game.

“Everyone here played in big stadiums before so everyone is prepared. It’s a huge game and will be a battle but if we try to enjoy it and be happy on the pitch, that will help a lot.”

With the Premier League title race also on the agenda for the rest of the season, Jesus feels we’re well prepared to tackle the upcoming tests thanks to the fitness of the squad.

“It’s the best part of the season for everyone who is still in the Champions League and also fighting for the Premier League,” he said. It’s exciting because these are the deciding games and small details count. Everyone is fit again and I hope everyone can give extra to help the team.

“The most important thing now is the fitness of the group. It’s only JT [Jurrien Timber] out but he’s coming back soon I hope, so this is good because it gives us extra power. We have a big squad with a lot of different qualities. We learned that you have to seize the small details like we’re doing now. Defensively, everyone is running back to help the team.”

Jesus has four goals in six Champions League appearances this season, but is more interested in helping the team generally than padding his individual statistics.

He said: “Maybe in the Premier League I have good stats as well but people don’t want to see! I want to win games and trophies so at the end everyone is happy, but I’m a striker and I want to score, I have to score so I try. It doesn’t matter which competition it is, I try to enjoy myself and help the team the best way I can.”

MACMILAN WABUTEYA: Governance Issues To Blame For Poor Service Delivery In Uganda

In a strict observation, governance issues in Uganda and most of the developing countries around the globe, tend to affect technical policies and subsequently leading to poor service delivery in various ways.

According to the World Bank, in 1993, governance was defined as the method through which power is exercised in the management of a country’s political, economic and social resources for development.

Thus, in a lay man’s understanding governance refers to the processes and systems by which organizations, societies, or groups are managed and controlled. For all that to happen, it has to involve decision-making, the distribution of power, accountability, and the establishment of rules and procedures to guide behavior in order to achieve the set objectives of an individual country, say for example, Uganda.

Good governance therefore ensures total transparency, fairness, and effectiveness in achieving the goals and objectives. This, therefore, a need for a mutual relationship in sectors like health, economic systems and good governance so that, they can foster economic development that is proportional to the country’s four principles of: Patriotism, Pan-Africanism, Socio-economic transformation and democracy.

In the global perspective, there are countries that have attained middle class income and are believed to be those countries that have regulated and realigned governance with technical strategic recommendations issued by experts.

The World Bank Middle Income Countries are a diverse group by size, population and income level, and are home to 75 percent of the world’s population and 62 percent of the world’s poor.

It’s in this, that the Middle Income Countries represent about one-third of the global Growth Domestic Product (GDP) and are major engines of global growth. For the current 2024 fiscal year, low-income economies are defined as those with a GNI per capita, calculated using the World Bank Atlas method of $1,135 or less in 20223.

According to the World Bank Country and Lending Groups, lower middle-income economies are those with a GNI per capita between $1,136 and $4,465; upper middle-income economies are those with a Gross National Income (GNI) per capita between $4,466 and $13,845; high-income economies are those with a GNI per capita of $13,846 or more.

In economics, gross national income (GNI) is the total income earned by a country’s people and businesses, no matter where it was earned. GNI is an alternative to gross domestic product (GDP) as a measure of wealth. It calculates income instead of output.

In Uganda, governance has taken a twist to caring interests of the a few people in its own cycle and yet World Bank provides increasingly tailored services—financial products (loans, guarantees, risk management products) and knowledge and advisory services (including on a reimbursable basis)—to support Middle Income Countries in their global roles, to universally address their second-generation reform challenges, and to facilitate knowledge exchange and South-South cooperation.

Governance space in Uganda

Political landscape:- Uganda operates under a presidential system of governance with a strong executive branch led by an elected president, however, concerns have been raised about the concentration of power in the presidency and the limited checks and balances on the executive power.

In Uganda, almost every top public servant is appointed by the president as his own referees to serve the interest of the president, for example, the electoral commission.

It’s against this backyard that the elite are grumblingly asking why these positions cannot be appointed by the various commissions in the country such as; the Judicial Service Commission and Public Service Commission who will do it on merit while following the commission’s guidelines so that officers appointed will serve the entire citizenry without fear or favour?

Democratic processes: Uganda has held regular elections since the introduction of multi-party politics in 2005. While elections are held, there have been criticisms of irregularities, including allegations of voter bribery and intimidation, lack of transparency, and limited space for opposition voices and freedom of expression for all.

A big question is those who are appointed into the top echelons of Uganda’s government agencies, are they aware of shrinking space in our country’s democracy and human rights observation? Uganda as a country has faced criticism from Western countries for human rights abuses including restrictions on freedom of expression and assembly. There have been reports of harassment and persecution of journalists, human rights’ activists, and political opponents. Thus, begging another question: “Was Uganda ready for multi-party dispensation?”

Corruption remains a significant governance challenge in Uganda, it has affected various sectors including health, education, works, and agriculture to name but a few and this has resulted in poor service delivery and business operations. Efforts to combat corruption have been made but more efforts still need to be done to strengthen it further by instituting anti-corruption institutions and enforcing accountability measures.

Though Uganda is touted for ushering in decentralization as one way of ensuring service delivery, the country to-date still grapples with challenges of delivering essential services such as healthcare, education, and infrastructure, particularly to the rural areas and this is caused by weak governance structures, and corruption.

However, it should be noted that decentralization has led to the implementation of some of the reforms such as devolution of power from the central to lower authorities. It has also led to increased local decision-making and community participation, there are concerns about capacity constraints, accountability issues, and disparities in service delivery among the regions in the country particularly those in the northern hemisphere.

This also prompts another question as to why the Central Government spends a lot of resources to a few institutions like the State House and Parliament where only a few individuals enjoy at the expense of the majority? Look at Uganda critically, it is one of the richest countries in the world endowed with prestigious natural resources but yet it’s one among the 42 Heavily Indebted Poor Countries like; Malawi, Chad, Benin, Burundi, and Burkina Faso among others because of bad governance.

In the news this morning, Forum for Democratic Change Najjanankumbi faction has announced the death of their strong woman from Teso Hon Sarah Epenu.

According to the party, Epenu served FDC in various positions as former Spokesperson of the women’s league and at the time of her demise, she was serving as the party chairperson for Kapir County Constituency in Ngora district.

Details surrounding her death are still scanty but reports suggest she died from Life Link Hospital in Kyaliwajjala in Wakiso district where she was rushed after complaining of general body weakness on Sunday evening at around 9:00pm.

Parliament last year passed the Anti-Homosexuality Bill 2023 and president Museveni signed it into bill in May 2023. Upon signing it into law, it’s implementation took immediate effect.

Like they did in 2014, veteran journalist Andrew Mwenda, Fox Odoi, Prof Sylvia Tamale, Dr Busingye Kabumba, Solome Nakaweesi, Dr Fank Mugisha, Kasha Jackeline Nabagesera, Richard Smith Lusimbo, Eric Ndaula, Williams Apako and the Human Rights Awareness and promotion forum petitioned the constitutional court to overturn the Anti Homosexuality Act 2023.

These contend that same sex intercourse between two consenting adults shouldn’t be a crime. They are also against the heavy fines, tough punishments including life imprisonment and death penalty which come with come with the Anti-Homosexuality Act 2024.

The controversial petition which was filed by Andrew Mwenda and others against the Attorney General on 29th May 2023 as the Key respondent on behalf of government was heard on 18th December by five justices led by Deputy Chief Justice Richard Butera, Geofrey Kiryabwire, Muzamiru Kibeesi, Monica Mugenyi and Christopher Gashirabake who heard the evidence and arguments presented to them and promised to give their verdict.

The justices of the Constitutional Court have today in a judgement read by the Deputy Chief Justice Richard Butera unanimously dismissed Andrew Mwenda and group’s petition and declined to nullify the Anti-Homosexuality Act 2023. The justices have ruled that the Anti-Homosexuality Act 2023 does not violate the right to practice and profession

JUST IN: Constitutional Court To Deliver Judgement On Anti-Homosexuality Act This Morning

When parliament passed the Anti-Homosexuality Bill 2023 and later signed into law by president Museveni, Andrew Mwenda and 10 other people petitioned the constitutional court like they did in 2014.

Veteran journalist Andrew Mwenda together with Honorable Fox Odoi who even opposed the bill in parliament petitioned the constitutional court to overturn the law. The other petiitoners include Prof Sylvia Tamale, Dr Busingye Kabumba, Solome Nakaweesi, Dr Frank Mugisha, Kasha Jackeline Nabagesera, Richard Smith Lusimbo, Eric Ndawula, Williams Apako and the Human Rights Awareness and Promotion Forum all see no importance in the Anti-Homosexuality Act 2023 and want it trashed.

On 18th December 2023, Five constitutional Court justices led by Chief Justice Richard Butera, Geofrey Kiryabwire, Muzamiru Kibeedi, Monica Mugenyi and Christopher Gashirabake heard both sides of the petitioners and the Attorney General and promised to give their judgement.

In a notice issued by the court, judgement will be done today and Ugandans will now know whether a repeat of 2014 will take precedence or the court will uphold the law.

Since passing the law last year, Uganda has paid the price by falling out with her western donors especially the US which has announced sanctions and even struck Uganda off the lucrative AGOA trade forum. World Bank has also suspended funding to Uganda because of the bill and tasked Uganda to put in place measures to protect homosexuals before funding is resumed to the pearl of Africa which depends so much on loans, grants and donations.

EC Now Wants Shs500m To Organize Prayers For Peaceful 2026 General Elections

Electoral Commission wants a whooping Shs1.119trillion to organize successful 2026 general elections. The Commission which has since released the electoral roadmap says it wants to start on the activities leading to the general elections.

Members of parliament on the Legal and Parliamentary affairs committee have however raised concerns over the Commission’s huge budget for the elections and the Shs500m to organize national prayers for the peaceful 2026 general elections which they say is blatantly unnecessary and tantamount to wastage.

These further say it’s wrong for the electoral commission to seek Shs18bn for private lawyers yet those paid by government in the commission can handle the electoral petitions filed against the commission in the aftermath of the elections.
